Ive now seen the PCN/NTKs and they have photos of the vehicle in the parking space which is kind of scary. Presumably they also have photo's of me leaving/returning to the car.
Does this change the approach at all? Probably not but thought it might be worth asking.0 -

You can appeal for them, (with their permission) and do all the paperwork.
This is because it is likely both NTKs are not compliant, meaning keeper liability does not apply
Well, the car is mine (it lives with me, I insure it, I am the only driver on the policy etc) it just happens to be registered in my mum's name as she collected it from the garage at purchase and they needed her signature to transfer ownership from themselves.0 -

I doubt it very much, who do you think they are MI5?0 -
I've received my first reply (from ParkingEye, the company managing the hotel parking charge).
Its a little bit of a woolly reply to be honest. I sent them this letter:
http://www.parkingcowboys.co.uk/wp-content/uploads/2013/10/Parking-Cowboys-Template-NTK-Challenge-131029.docx
And they have replied with:Thank you for your correspondence in relation to the Parking Charge incurred on [date] at [place]
We are writing to advise you that your recent appeal and been unsuccessful due to the fact that valid/sufficient evidence was not provided to show that the terms and conditions, stipulated on the signage were not broken. We are fully compliant with the British Parking Association regulations on signage and confirm that there is adequate signage at this site that is visible, appropriately located, clear and legible. However as a gesture of goodwill we have extended the discount period for a further 14 days from the date of this correspondence.
It then goes on to say POPLA is available and if POPLA fails I will need to pay the full charge and how to do this.
Is it worth entering into a "debate" with them as to why they haven't provided any/all of the information I asked for in my original appeal letter. They seem to have only concentrated on the signage and not the contract, what the claim is based on and all the other stuff in that letter.
Or, is it better just to pay one of those companies that appeal of your behalf?
ParkingEye have also helpfully included a page which lists all the times they have won or a judge has made a judgement in their favour (and there aren't many of them!)0 -
hold on , you say "Ive now seen the PCN/NTKs and they have photos of the vehicle in the parking space "
but earlier you say "Both were on the 30th July and in England and PCNs arrived by post today (10/08)
where those tickets on the car or not , or a more interesting question , how does a ANPR camera (set to record numberplates in a fixed area) manage to take a photo in as you say ""Ive now seen the PCN/NTKs and they have photos of the vehicle in the parking space "
and to add:
you state that PE have declined your appeal , and told you about POPLA , but have they included the 10 digit code to do this?0 -

If this is the one that opens with 'Without prejudice, save as to costs', I presume you understand the implications of that statement? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

The NTKs were sent to the address that the car is registered to, which isn't my address. These have now been forwarded to me, hence the "I have now seen the PCN/NTKs" as I hadn't originally received them through the post.you state that PE have declined your appeal , and told you about POPLA , but have they included the 10 digit code to do this?
They have, but in my opinion it is done in a kind of sneaky way. Yes, the POPLA code is at the top of the letter, and the letter mentions POPLA but no explanation of what the code means, or how to use it/what to do.0 -
