JSA whilst laid off

Hi All,

If someone has an employment contract that allows them to be laid off without pay, but requires them to be available for work for a further 3 months, can they claim JSA if they start looking for work during those 3 months?

I know potentially they would be in breach of contract with their current employer by taking another job, but if everyone is 99% sure the present employer is going bankrupt anyway they will not be require to return to work.

Could this affect the claim for JSA if the employee is genuinily looking for work and planning on taking any work they find. Or would the DWP try to confirm the contract with current employer?
