Bounced Cheque

Morning

I issued a cheque to pay for a party at a local community hall for £50. Today I had a phone call saying that the cheque had bounced. Bank has always had the funds in for this cheque to be taken. So I rung bank to tell me why it had not been processed and they told me its not on the system as being cashed ( they can't find the cheque). The hall now wants £50 plus £4 fee.

Questions are

Who gets the cheque back?

What notification should he get to know cheque has bounced?

Why wouldn't it be on bank system?

Should I pay cash (as they are requesting now) if there is no proof of cheque bouncing?

Hope someone can help as I'm lost.

You could cancel the cheque as being lost then pay again.

How can it have bounced if it has not been presented for payment?

If the cheque had bounced, the cheque would have been returned to the payee - do they have it?

That's what the bank is saying that they may have lost the 1st one and covering it with a new one.

But bank is confussed also as they cant find the system. I'm waiting to hear back from them as to be honest I want the bounced cheque before I hand over anymore money.

That is what I'd do await to see the see bounced cheque which would have printing on it saying refer to drawer, If they cannot provide this tell them then until they do so a payment will not be made.

Not sure if it costs to stop a cheque as it has been so long since I last issued one from my personal account.

    A lost cheque can't bounce!
Ask the community hall if they have been returned the cheque or not.

    In answer to your questions

1 the person who paid the cheque into their account gets the cheque back

2 he'll get a letter with the cheque attached to it. You should also get a letter from your bank telling you the cheque has bounced, and given the reason why it was unpaid

3 why wouldn't it be on the banks system? I suspect it wasn't paid in in the first place

4 only pay cash if the payee gives you the original cheque back..

There are many reasons why a cheque can bounce, even if you have the money in the account - it could be returned if you forgot to sign it, if the words and figures differed, if it was undated, posted dated, undated and so on

You drew a cheque on your account in favour of the Administrator of the Church Hall Account.

The Administrator paid it into the Church Hall Account and the bank where that account is held has advised the Administrator that it has bounced?

Was the cheque returned to the Administrator marked "Refer to Drawer"?
But bank is confussed also as they cant find the system.

What system? Surely not its own?????

Now I'm "confussed" (and bothered and bewildered...):)

On the one hand - Sounds like it was never paid in, as the bank should have a record if it returned the cheque. On that basis you should be wary of issuing another one without stopping this one, but stopping it will probably cost you around a tenner.

On the other hand - Unlikely a community hall would intentionally defraud you, so maybe worth issuing another cheque on the basis they'll refund you if paid twice by mistake.
