Pcn on lower loveday st birmingham for not parking in a marked bay

Can anyone help please?
I parked on a car park on lower loveday st in birmingham. Some spaces have the white line markings for the bays but others have small yellow t's. I parked between two cars not noticing the t's and bought a ticket for 24 hours. We returned the morning after to a ticket saying we weren't parked within a clearly marked bay and a ticket for £60.
One of the cars by the side of us had gone but the other one was still parked where he had been which was over the t which in turn made our space further over. The car next to us did not have a ticket, neither di others parked like this or another car that was parked at the back of some cars and clearly not safe. We came back later in the day and another car on the car park had got a ticket and the owner was as bewildered as us.
We took photos of the signs which say parking has to be within the clearly marked lined bays. Along this stretch of the car park there were no marked lined bays.
I have appealed the charge on these grounds sending photos of other cars parked the same way ( blanked their reg nos out) and have had a letter back saying our appeal has been rejected as we should have followed the signs and parked where there were white markings if we were unsure about the t's but at time all the spaces were full. The car park is made up of 50/50 spaces some white lines and the rest small yellow t's which are not very clear. Then they said they were not entering into anymore correspondance. We can go to an independent appeals process. If we pay within the next 10 days we get it at the reduced rate otherwise it goes ip to £100.
I just want advice as to whether we are just better paying or if it's something we can fight against but i would need a strong argument?

We need to know the name of the parking company in order to advise you further.
Have a read of the Sticky thread for NEWBIES at the top of the main page. This will tell you what you should have done, and what you should do next, but this will depend on whether the parking company is with the BPA or IPC. That's why we need to know the name of the scampany that sent the NTK.
You paid for parking so the PPC has made no loss so do not think about paying. You owe nothing. the NEWBIES sticky thread deals with IPC affiliated parking companies like Excel, who use the kangaroo court called IAS for appeals , which is weighted against you
Excel have 6 years to try a court case (MCOL)
its your choice as to either paying (which we dont recommend) or fighting it in court if Excel ever issue court papers (which is good if you have a strong case , like no locus stanii - no authority , no contract , poor signage etc)
you could appeal to the IAS within 21 days but its likely to fail, levaing you back to either paying or await court (or the statute for small claims runs out in 6 years time) but you have nothing to lose by trying it and including signage pics etc
the choice is yours0 -
Being members of the discredited I.P.C. gives you a huge advantage.
Appeal to the PPC, they will reject, appeal to the I.A.S., they will reject. Sit tight, they are highly unlikely to do anything but send you threatening letters which they will not follow through.
If they did take you to court, show the judge the IAS refusal. ,You never know how far you can go until you go too far.0 -
