Please can you confirm that my payment in lieu of notice will not be affected by not claiming JSA?

No, because it will be affected.

You cannot take adoption leave - you have no employer! Your choice is look for a job (and claim JSA) or don't look for a job and not be eligible for JSA. Pay in lieu of notice results in an automatic deduction for the amount of JSA claimable, whether you claim it or not.

You qualify for the payment less the JSA you should be claiming.

I have been made redundancy by my company who has gone into administration. I was told by the Administrators that I would need to claim Redundancy, outstanding leave and payment in lieu of notice through the Government's insolvency service. I have completed this online. The confirmation states that my payment in lieu of notice can be affected by not claiming JSA. I am eligible for 12 weeks' payment in lieu of notice as I worked for the company for more than 12 years. I had only recently (four weeks) returned to work from adoption leave when I was made redundant and I had returned early (i.e. cut my adoption leave short) at my companies request. I am therefore planning to take the remainder of my adoption leave (3 months) to be with my young adopted children and was not intended therefore to claim Job Seekers' allowance as I did not intend to be available for work. Please can you confirm that my payment in lieu of notice will not be affected by not claiming JSA? To clarify, it is my intention to take a break to be with my children for the immediate future, therefore it would not be appropriate to claim JSA at this point in time, until I choose to return to (part time) work. I was employed 17.5 hours per week and when I do return to work (early next year), i plan to do so on the basis of the same hours given my childcare commitments. Grateful for any advice offered.

Can you imagine what these forums would be like if everybody did this after they got the information they wanted?
  • Hi Johno100 - I realised I had gone into quite a lot of personal detail in my original post (particularly in relation to adoption leave etc) hence I edited the post down to the essence of the original question which was whether JSA is automatically deducted from PILO whether it is claimed or not. Grateful for the replies here as I understand now that it is deducted regardless of whether JSA is claimed or not.

    Thanks again everyone.
