Just a short update for you all

I have applied for judgment to be stayed. Court has it registered as i had paid £165 fee. But since queues are long, i may have to wait a long time to see if i've been allocated a hearing. Now, because of this i have decided to submit payment CEL (who do not own the debt) and submit evidence of attempted payment to Wandsworth CC

    Both have cashed their cheques

Anyway, lost out in the interim (£215 + £165 + £15) but i hope to recover part or all

oh dear , as posted at pepipoo , a silly move , PS , have your cheque ready for DEAL before they send the bailiffs in

The claimant (CEL) won and that's who he paid. !!!!!! is is wrong with posters who say he's done it wrong ? Why pay a sum to DEAL when the judgement is to CEL ? If people want to help that's fine but if all they wish to do is regurgitate garbage without having a clue then perhaps they would be better to say nothing.

I assume when he says stayed he means set aside.

ok , who placed the ticket on the car , CEL , who bought the debt FROM CEL , a company called DEAL
who took the OP to court and won , yup DEAL , who should the money have been paid to , yup DEAL

who did he pay ,,, CEL

DEAL have not received the money claimed , he could ask CEL for it back tho

So he should ignore the court because you believe, quite correctly as it turns out, that the legal owner of the actual debt (as opposed to the owner of the judgement debt) is DEAL ?

It wouldn't be DEAL that was recorded on his credit file because they DIDN'T GET A JUDGEMENT FROM THE COURT, that was CEL.

No. There are several cases where CEL assigned to DEAL and then CEL took court action on their own.
  • where there ,can you point out a case (as in this coop) where they have assigned the debt (82%) to deal , then proceeded with court action , only owning 18% of the debt ?

I have looked back the this site , pepipoo and the pransters site but cannot find one.

it sounds like , although we have not been told properly that it was infact DEAL that instigated court.

and one piece of paper , the assignment notice was not received by the OP.

OP , WHO took you to court , WHO got the CCJ , can you categorically say it was CEL or are you surmising it was ?

    You're kidding right ?

CEL have decided to issue me with a Northampton County Court claim for this PCN
This morning I decided to give up and pay, but Civil Enforcement Limited would not accept my payment as it is now payable to DEAL - Debt Enforcement and Action Limited which was not involed in the case as Claimant and i don't have any contact details to them

    From the op.

    And these from #32

  • ok , that IS VERY unusual , however it is only the claim form , I think this might have morphed over to DEAL ,

but we will know more later
  • Dear All

A day has come that I was allocated a hearing having paid the judgment and then making an application. The hearing is today (after blunders by court it was cancelled then reinstated). I have my defence, my skeleton argument. And basically ready to go

    - Any last minute advice on what should be my main argument? (I have several as you know)
    - Any reiteration on Beavis (hear judgment is due 21st Oct)
    - Any mention of criminal case against CEL in Scotland?
    - Anything else

Many thanks. I appreciate all of your input
