Giving notice to letting agent

My tenant has advised me that she is buying a house and will be moving out of the property (England) so I have decided to sell the property. Do I need to give the letting agency formal notice or will my contract with then end when the tenancy ends?

    If you are unable to manage it yourself I would say sell anyway, as the agent has just skimmed off all your profit each month, which on buy to let is between 10-15% PA of the rent.
    They secured the profit or cream off the milk without making the investment.
    Using agents is not an option if you are in the game to make money.

  • Generally speaking the tenant should have given the agents notice. They will in turn contact you to find out what you're wanting to do. That being said, if the tenanthas already told yoj of their intention to leave, and you've not yet heard from the agent, that doesn't bode well. Emakl the agents informing them of your intent to end their services at the end of the tenancy. No notice needs to be given as the contract ends at the end of the tenancy. You could market your property from now, just to geg ahead of the game
  • The tenant is an employee of the letting agent. I have a very good relationship with her which is why she told me first. She doesn't have a confirmed leaving day yet and I am willing to be flexible if she will allow viewings to take place while she still lives there.

    I rented out the property when I moved to Glasgow to see how things went but don't plan on coming back so hence decided to sell.
  • The management service agreement says "if a landlord wishes to introduce a property to the sales market xxx will be granted the sole selling rights for a minimum period of 12 weeks". Does this still apply if I put the property up for sale after the tenancy has ended?

    I suspect that clause is meant to apply if the property goes on the sales market while the letting (and letting agency contract) are still in place.

    However it is ambiguous.

    I should terminate the tenancy, and management contract, before starting to markey the property.And I would not tell the leting agency of your intention to sell.

    Wait for the tenant to give proper formal notice (ideally in writing to the address provided for that purpose). Wait till the tenancy ends and tenant leaves.

    Once the tenant has left you wouldn't be a landlord any more so I can't see that one holding up in court.

  • Jesus your agents sound like right t**ts. To hold you in to a contract that means you MUST sell through them shows just how much they must be struggling for business. If you had a good relationship with the agents in the first place, one would assume you would try and sell through them. Putting it in the contract that you MUST would put me off even renting through them

    They're ok, just don't want to give them c £5k. I don't think their marketing material is the best, although as it's in London I don't think it will take long to sell.
