Hi,
A while back a friend of mine received a parking ticket for parking on private land- they followed the 'Newbies' method's and have now reached the stage where the issuer/enforcement company has sent a rejection letter with a POPLA appeal form and code, could somebody kindly advise on how best to proceed?
Thanks in advance:)

use the forum search box and put some search words into it that help you to find recent examples of popla appeals , then plagiarise a close match for 2015 only (ie:- this year)
also look at the last few pages of the sticky for POPLA DECISIONS and see what the winning arguments were , also checking that persons popla appeal if published on here
in other words, do the research on recent appeals and wins, using suitable search words and also looking at other members recent 2015 appeals
and check the popla code is valid and check its expiry date too, as detailed in the NEWBIES sticky thread0 -
No standard text as such, but your appeal needs to cover the following:
1. No keeper liability (but you need to check the NtK for correct dates and all requirements of PoFA have been included) - see here:
http://www.parkingcowboys.co.uk/keeper-liability/
2. Signage
3. No Contract with landowner to pursue charges in their own name at court
4. No proprietary interest in the land
5. Unlawful Penalty Charge
6. ANPR Accuracy (if appropriate)
7. No genuine pre-estimate of loss (GPEOL)
Read very carefully post # 3 of the NEWBIES FAQ sticky - it contains information important to your appeal.
There are plenty of examples of winning POPLA appeals across the forum; here are a couple of links for you to follow and research:

Read from the most recent backwards to get a feel for the appeal points on which POPLA Assessors are currently upholding appeals. Please note, we are not a legal advice forum.
