Hi All,
I am hoping someone can give me some info. Basically to give you the back story my girlfriend and I are buying a property and unfortunately one of the sellers passed away just before we could exchange. Basically the grant of probate has now come in, and i was wondering what is the next step? Will we be able to exchange and complete now? I believe the estate is being left to the wife so its was pretty straight forward. But not sure what happens next. Basically our solicitor is away today and not back till Monday and i want to know our position rather than be in limbo over the weekend!

Once probate has been granted the executors have the legal authority to sell/transfer the house, so the sale should now be able to proceed as normal.0

If the house was in joint names as joint tenants there was no need to wait.0

Thanks for the replies, I believe the property was in the husbands name as our solicitor couldn't exchange and had to wait for grant of probate. If so, do they need to transfer over the details with the land titles office before we can complete?0
