Problem with courier company.

Hi everyone was looking for some advice on how to deal with a problem. Not sure what all is relevant but will try and keep it short.

Had a wedding wish list on Amazon and a kind relative bought us a tent from it. They live far away so asked for it to be sent to ours then told us when it should be expected and sent me the tracking number. Delivery time passed so I checked online and saw it had been marked as delivered. There are two streets with the same name where I live so it's not the first time things have gone missing. The company told me that they had tried to deliver it to the wrong house but nobody was there so they left a card. Person at that address then took card and collected parcel. The man on the phone admitted they hadn't asked for id. They said the person who bought it would have to call and arrange for another one to be delivered free of charge. Second tent arrived so we thought all was sorted. A week later another tent arrived so we called Amazon who apologised for what had happened and said it wasn't worth coming back for it so we could keep it and donate/sell/bin. I made sure to tell the person who bought it just in case and made sure I had it in writing that we could keep it.

A week later the courier company realised there mistake and has been emailing (coming across as a bit threatening) the person who bought it saying they want it back. Amazon told the courier company they are not allowed to collect it and that it was ours to keep. However while we were on honeymoon the company has tried on 6 different occasions to collect it. They only caught us once and we told the driver we had no idea what he was supposed to collect (we guessed but hadn't been in touch with the relative)

My question is what kind of rights do we have? Since we have only got one copy of an email so far sent to us saying we can keep both tents does this still stand. Can I contact the companies involved even if I have not been the one to pay. I have no problems handing tent over but it just feels unfair that one of us needs to take time off work to wait for them to be able to collect it when it was their mistake.

No need to stay off work. Just tell them when they can collect it at a time convenient to you.

But why should they if they have been told by Amazon they could keep both of them?

You have proof that the retailer has said you can keep it. Therefore you can.

However, if the courier are hassling your friend, it may be easiest to return it for your friends sake.
  • Thanks for the replies. The courier company has been told by Amazon twice not to contact us and as far as the relative knew they had dropped the matter. The problem is they keep turning up at random to collect tent without permission or a set date and time. My other half is now back to work on night shift so it's a bit of a pest him being woken up but it no fit state to open the door. Going to try and call them again today and see what they say. Do you think I should contact them both or just stick with Amazon?

Write to the courier stating that you had a contract with amazon, not the courier. That - as far as you and the retailer are concerned, the issue has been resolved to the satisfaction of both parties.

That if they (the courier) have any dispute with amazon they should be taking it up directly with them and not you - a third party - and that should they continue in their behaviour, you will be filing a complaint against them with the police for harassment.

Note: not saying to actually contact the police at this stage but they certainly have no right taking matters into their own hands and their behaviour could be deemed as harassment - especially if amazon have told you to keep it and haven't asked them to collect it as then they're acting off their own backs rather than a contractual duty.

Just an update followed by more pleas for help! I called the courier company the day after the last collection and was promised I was removed from their system. Guess who just turned up again! This time the driver just put a note through asking if there was still an issue and if not the would come back. I called and asked for a manager who has promised he will "try" and stop them but telling the depo not to come back. This is the same promise as last time. Getting really annoyed now but still trying to be polite. Is there something else I could be doing to make sure they leave us alone. Poor husband yet again got woken up and took about an hour to drop off again. Means again he will be tired at work tonight. Help!

Sorry an edit to ask if I still have any rights to contact them. So far they have taken all my calls but I technically didn't order/pay for anything since it was a gift. The person who bought the tent is now going to check and see if this is the seller on Amazon trying their luck at getting it back. They have been given a refund and so they would technically end up with the tent plus money in the end if we caved in and gave it back.

Have you written to them as I advised previously?

  • They have been emailed several times by the person who bought it but not sure if they have written or not. Part of the problem is we don't know exactly who is requesting the pick up. Amazon say it's not them, dpd say it's not them, there is a company collecting on behalf of dpd who say it's not them. Last people to try is the seller on Amazon. I have emailed trying to find out who that is. Hopefully once I track them down I can then send a letter asking them to stop.

borrow a LARGE dog.................let the LARGE dog bark and bound around for a while
answer the door.....................ask the courier to come in while you fetch the tent.................let the LARGE dog bound around a bit more...............bet you won't see them again.........
I have a VERY friendly very LARGE dog........who bounces like a spring lamb..........happy to lend him to you................he wouldn't hurt a fly, but LOTS of cold callers don't even approach the step when I open the door holding his collar.............mind you - if they ever start to talk to the hermes courier and the post lady, I'm scuppered as the Hermes lad is on first name terms with the dog and brings him balls and toys and the he always wants to follow the post lady.............

Was it sold directly by Amazon or one of their trird party sellers? if it was by a third party seller then it's not Amazons place to let you keep it.

If it was a marketplace seller then give hithem it back !!!!!!, it's not your to keep.
