If someone with three children two sons and a daughter makes a will to leave equal amounts to each, then the daughter dies bit the will is not changed ,does the money go to the remaining living children (her two sons) or if the daughter has a living husband would it go to him, or would it go to living children of the daughter

    It depends.

    I believe the default is that it goes to the surviving children, not the husband, BUT my parents' will specifically excluded the grandchildren if any of us pre-deceased them.

    So, what does the will say?

    Yes, unless the will states otherwise, the deceased daughter's portion will go to her children.

    You would need to post the exact words (without any names of course).

    It will not go to her husband unless the will states otherwise.
