Hi I hope you dont mind offering me some advice. I brought some gift vouchers on my selling id off a person with 100% feedback. The cheque was cashed 17 April. I gave it a week and politly emailed asking when could I please accept delivery. No responce. Ive put in the item not recieved thing with Ebay. His phone looks to be cut off. Ive emailed countless times. Have been in touch with the bank to see if they could help as I paid by cheque. Now im almost £50 out of pocket and no vouchers. Can anyone please advise. The only thing ive been told to do is write via recoreded delivery enclosing small claims court forms filled in. Is this correct?

Sounds as though that's all you can do..reading between the lines if he's been NARU'd now looks like other ebayers will have had similar complaints causing his account to be closed. If you've got his address I'd consider phoning the police in his local area and see what they say (this has to be theft surely?). Ebay probably won't be much help :rolleyes: as you didn't pay with Paypal...or you would have been able to do a chargeback.
Sorry can't offer anything more positive...but at least he's been kicked off ebay now.0 -
S do you think the small claims is an option. It was suggested to me. You just fill the forms in on line. I think just seeing the forms might get him to refund me. Or am I beint OTT2007 is my getting slim year

Yes I'd definitely try that option. Maybe the threat of a CCJ against him may scare him into a sudden rush of conscience/refund. Does it not cost you to file a county court small claim? If so don't forget to add those costs into your claim.0

Are you sure your bank can't do anything? Bit of a poor show - mind you not suprising in the least.2p off is still 2p off!0

Are you sure it is worth risking paying money to take someone through the small claims court? If you can serve them a notice they can choose where the hearing is so not only do you have to pay the claim charge (approx £36?) but also fares to get to the court.
Even if you do get them to turn up you still might not get your money back. If at all possible can you contact the other buyers and see if you can do a combined charge through the small claims court.
I'm sorry I can't be of any more help, I gave up buying anything at all on ebay unless I can use paypal.

I think ive been given some incorrect advice elsewhere. Ive just phoned Abbey my bank and they cannot help. But I was told that you can print off and send the forms for the small claims court from online. I wouldnt ever go to court but I just wanted to kick him up the bum. Ive got his address so im off to write a letter by recorded post now

You can do all the County Court stuff online, however to register a claim against him you would need to make a payment to the court.
It never hurts to tell a seller that you are planning small claims action against him, he may be worried enough to do something.
