PPI CLAIM, Old mortgage co. playing about over ID

Options
Hi all

I am currently in an IVA, and through that they are doing PPI investigations on all my creditors, I was married once and had a house and mortgage with my ex, we moved the mortgage from once company to the next via an advisor and then out of the blue our mortgage was then passed on without us evening knowing to another company which was fine etc, anyway we divorced and the house due to circumstances was taken and sold by the mortgage company after a hearing which I attended on my own !!! with no help or representation, the mortgage company took me to one side prior to this and asked my intentions etc, I couldn't afford the mortgage and neither could my ex despite him being in the property still. they mortgage company then took the house off the market with the estate agents it was with and moved it and sold it for 1 nearly 20'000 less than what was on the mortgage... devasted I ended up in the situation i am now in, now the PPI company have passed on letters i had copies of all my ID documentaion , as I am no back in my maiden name, they have had everything twice, they recently requested my decree absolute again.. now I have a letter from PPI today saying they now want further proof of my ID this has gone on for longer than they have had time to repsond they just keep going and going asking and asking and we have more than proved who I am they;ve had driving licenses passports old and new with both names on, ridiculous now they want my marriage cert or deep poll name change cert!!! to be fair as we know if you divorce you are more than entitled to go back to your maiden name by law, however I do know that some financial organisations may request deed poll name change but Ive been my maiden name now since 2008 so I don't see why I should have to pay to prove that..... this old mortgage company who we never asked to be with in the first place have dragged this out so long now! I'm wondering if there is anything Legally I can do or the PPI company can do to force the issue...... they want marriage cert if poss well they should know that if you divorce you surrender your marriage cert to the solicitors at the point you file for divorce... I'm just annoyed at constantly having to send documents to prove who I am, I'm starting to wonder now if this is going to actually mean that they may have indeed mis sold PPI I mean we never asked to be with them when we did run into financial difficulties when my ex was out of work due to ill health they said we didn't have a leg to stand on basically hence the problems and debt and then the house being sold by then for considerably less, its a lot of money ..I just want to know really and they are clearly dragging it out and playing up even the PPI company said they don't understand why they are dragging it on when they have more than proved my ID!!!What can I do or what can the PPI company do. I'm fed up of being asked for things I've already sent!!! HELP, cause if they owe me it will make so much of a difference to my IVA debt ie to clear outstanding debt and any over would come back to me which I'm not bothered about I just want to be debt free and my IVA seems to be taking forever.. any advice..sorry for the long rant.. I'm jsut fed up no Ive had this cloud over me since 2009 i've paid hundreds if not thousands to debt plans and now IVA and my debts have hardly budged I'm looking at 2018 to be debt free :(

now I have a letter from PPI today saying they now want further proof of my ID this has gone on for longer than they have had time to repsond they just keep going and going asking and asking and we have more than proved who I am they;ve had driving licenses passports old and new with both names on, ridiculous now they want my marriage cert or deep poll name change cert!!!

They have to be able to see the change of names from beginning to end. Any gaps need to be verified.
o be fair as we know if you divorce you are more than entitled to go back to your maiden name by law, however I do know that some financial organisations may request deed poll name change but Ive been my maiden name now since 2008 so I don't see why I should have to pay to prove that

They need to make sure you are who you say you are. As this is a old account that is in a different name, they need to check this.
I'm wondering if there is anything Legally I can do or the PPI company can do to force the issue.

No. Failure to comply allows the firm to refuse to deal with you due to being unable to verify your identity.
I'm starting to wonder now if this is going to actually mean that they may have indeed mis sold PPI

They probably havent even looked at it yet. Indeed, from what you say, its possible that a) you never had PPI or b) you used a broker and the lender wouldnt know if you had PPI or not and will automatically reject it as you didnt do the PPI with them.
even the PPI company said they don't understand why they are dragging it on when they have more than proved my ID

Current ID is not enough. its the whole period that matters so they have a full audit trail).

If you did have PPi with the lender, then you would only get half as your ex gets the other half. Plus, if the mortgage was not cleared in full by the sale of property, then they can use the capital part of the redress against that unpaid debt and not pay it to you.

Also most MPPi complaints fail. So, you should be prepared for that.

I think the OP is saying that the property was sold at a loss.

That means if they win, the lender will be entitled to hang on to the money and the CMC will send the OP a bill for anything up to half of what the lender decides the redress would otherwise have been.

Thank you MAGPIECOTTAGE for your kind reply ... :) I come on this site for support and advice, not a lecture or put down over lack of punctuation. Thank you for being so kind.

Paragraphs and punctuation please. Your post is barely readable and I, for one, can't be bothered to decipher it.[/QUOT

Thank you for the constructive, adult, and totally unhelpful response. Ever heard of the saying "If you can't say anything nice, Don't say anything at all"?

I'm 40 years of age, and I come onto this site for help, advice and support in areas I am not so clued up on.

The fact my original post lacked punctuation, well that's the least of my worries. When I just want to get as much information down as fast as I can. Is it really that much of a problem?

I suggest you refrain from being so abrupt to anyone in future and if you can't offer any constructive advice and help or support. It's quite upsetting to get the time to come back on to see what responses I have and only one of the 3 is a kind one.

He was only telling as it is, many people including me won't even attempt to read a post like your first one, it's just too painful on the eyes.

It may have been abrupt but it was at least constructive in that you now know how to construct a post that will get read by more people, so are likely to get more people responding. Dodgy spelling and punctuation are forgivable but lack of spacing and paragraphs is not.
