Ex died and has apparently had a lodger in our jointly owned house

  • A developer would only offer a price he can make money on, normally around 25% below market value. You should get some estate agents round to give you a market value

    But that would leave the OP needing to ensure that she had complied with the legal responsibilities of a LL such as Gas Safety Certificates, legal periods of notice and deposit regulations. If the lodger decided to get difficult, he could bring in Environmental Health.

    OP, I would suggest getting three estate agents in to value the property as is. Then consider auctions with the reserve price high enough to redeem the mortgage and other costs.

    You will need vacant possession prior to the auction.

    Very few people will buy with someone in residence unless they want to be a landlord so you will need vacant possession.
    Can you go back to developer and explain the minimum you will accept is x amount? His first offer may well have been a low, cheeky offer.

    I've had 2 estate agents round today to value. Should hear in the next couple of days. I've also asked for any rent to be paid into my daughters account. I won't touch it unless absolutely necessary.
    Thank you for all the replies. It really helps. I've been struggling with coping with it all If I'm honest.
  • You might want to take advice on accepting rent money as this may create a new tenancy and give the druggie another 6 months plus in the house.
    I'm sure if you hop over to the house buying, selling and renting board on here they will steer you in the right direction.
