Returning to work for NHS within 12 months - pay?

Hi

I was made redundant from my band 5 job at the end of Jan this year and am returning to work for the NHS (different trust) at band 3 , can I start on the top of the band?

I've looked through the agenda for change and have only found annual leave for 5 plus year's service will stand.

Anyone know?

    You'll start at the equivalent point you were on before, but on the new band. For instance, if you were Band 5 Point 20 (+5), you'll enter at Band 3 Point 10 (+5).

    I left one band 3 job almost at the bottom of the scale, took a band 2 job. They elected to put me on the bottom of band 2. I think they said I needed to have been working within 3 months to have protected pay level. Ten months later I left that job and started another band 2 and they were appalled that I'd been put on the bottom of the band and put me straight on the top of band 2.

    So sometimes it's just up to them what they do!

    I've now left that job and getting better pay again outside the NHS.

    I can't help with the answer. I just amazed, that after leaving employment with a redundancy package, there would be any automatic link between previous pay position and that offered on a new job.
    I'm not being critical of the OP asking the question, just gob-smacked at the situation.

    It's linked to experience. You work your way up the points on experience so if you already have the experience they can start you on a higher point.

    It depends on competency levels - for instance if you were a Band 5 nurse and then returned as a Band 3 HCA then you could reason that you meet the full competencies required and could argue that you should be at the top of the band. However if you returned as a Band 3 Payroll clerk, for instance, then you would struggle that you meet the full competency required and it would be down to management discretion.

    I took VR from the nhs at the top of B4, and have gone back to a different job in the NHS at the bottom of B4. I start again with holidays too. And that's after 7 years service.

    So you really need to check with payroll because it may not be as cut and dry as you think. Once your service has been severed for whatever reason, it may well be that you'll be starting back as a new starter and your previous service bay not be recognised

    You have a contractual right to have previous reckonable service recognised - refer to sec 12.1/ 12.4 of your t&c's (p.63).
    12.1 An employee’s continuous previous service with any NHS employer counts as reckonable service in respect of NHS agreements on redundancy, maternity, sick pay and annual leave.
    12.4 On returning to NHS employment, a previous period or periods of NHS service will be counted towards the employee’s entitlement to annual leave

    Ohreally - 12.1 refers to 'continuous service' as the OP has been out of the NHS for a year, the continuous service is broken. When I worked in the NHS (just as AFC was being implemented) a break of less than 3 months was regarded as continuous.

    At my previous NHS Trust, we wouldn't automatically start someone midway up a point based on previous service, it would have to be negotiated.

    OP - I would recommend speaking with HR and trying to negotiate a higher salary.
