PCN advice needed please.

All advice would greatly help, i have already wrote a letter as the keeper of the vehicle declining to pay the PCN

I now wish to appeal through POPLA and i just need some advice what to say my grounds of appeal are and increase my chances

I was parked in a "smart parking" private car park it clearly states on the signs "up to 3 hours FREE"

I was busy in the town centre and knew that the 3 FREE hours would soon be up, so i popped back to the car where i then payed for a ticket which would easily cover the rest of my stay before the last ticket had expired.

I then received a PCN, it does state on the signs "no return within 2 hours" but at no point did i move the car and return? but the first 3 hours are FREE and i returned before the FREE hours ended and payed for a ticket.

Even if i am wrong in the way i bought a ticket ,on the grounds that they lost no profit and the charge they are asking for is ridiculously over priced, please help!

Here is the sign in the car park, i found it somewhat confusing.

I do have a picture of the car park sign but cannot link as new user, but can email on request if you need.

    You need to read the NEWBIES FAQ sticky at the top of the forum's thread list, one page back from here. It will give you all you need to know about how to fight this (I presume you and your parking ticket are in England or Wales).

    Have you had your appeal formally rejected by Smart Parking and received your POPLA verification code?

  • yes, they have rejected my appeal and i have my POPLA code, just hoping for some advice, i have read through alot of threads and webpages, but i find it quite confusing. I am hopeful that i could get help through this thread.

    check the code and its expiry date on parking cowboys using the code checker

    thenjust put some search words like smart popla appeal into the search box on here, find a recently drafted appeal by somebody else, and copy and paste it into notepad, then adapt it to suit

    items to appeal on include

    NTK not POFA 2012 compliant
    no contract
    poor signage
    anpr cameras accuracy
    not a gpeol
