Housing Benefit - Name(s) On AST

I'm currently helping a friend with the paperwork for an initial Housing Benefit claim. Their tenancy agreement (Assured Shorthold Tenancy) is in joint names with their now departed partner. As far as I can see this shouldn't present a problem, but confirmation would be helpful

    I think she should be having the tenancy changed to her name only for clarification

    It might do if they are under 35 as they would only be eligible for the shared room rate of local housing allowance.

    Why is the partner still on the tenancy agreement? He/she is still liable for the rent since it is a joint agreement. This will probably cause the council to question why there is a single claim.

    Your friend really needs to get her ex off the tenancy.

    She's over 35 and has children What happened is that her partner moved out part the way the AST term due to a breakdown in their relationship. There will both cost and hassle from LL amending the AST which she is keen to avoid unless absolutely necessary. I would imagine that this is a common enough scenario and she's primarily concerned whether the LA will accept the AST in its current form. Her former partner is more than willing to provide proof of his moving out if required.

    It would be fine with accompanying letter explaining the reason ex partner is still named.
    It's a very common thing we see as it can cost a lot to have a name removed from an AST
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.
