Help with old debt

  • I do understand. .. but what if it's not statute Barr what happens then.
    Sorry to be so negative but this is what I have been reduced to since my.attacks.

    Rang national debt line last night and was on hold . Awaiting call back.

    Why would it not be statute barred? You say that you have heard nothing since 2007. Let's assume you made your last payment you made was 31 December 2007. Since then you have not made a payment, not acknowledged the debt in writing.

    The last day they were able to start court action was 31 December 2013.

    You did phone Cabot (not a brilliant move) but acknowledgement has to be in writing so that doesn't count. Even if you acknowledged the debt in writing or made a payment now that does not change the legal standing of the debt.

    It is not impossible that they might try something - they have after all paid a few hundred pounds for this and were hoping to collect at least 10k from you. Clear Start were also hoping to make money by selling you a dmp or an IVA.

    What you should do now is send the statute barred letter and see what comes back

    I did make some payment of tiny amounts but dont know when that stopped but know its a very a long time ago.

    but have moved three times in the last 10 years. and have not had no letter from debt at all.

    if letter comes back I have to pay then I will tackle that when it happens
    as for contacting cabot.. i felt I had too as clear start was obviously feeding me wrong information and felt i had to ring them.
    as I stated the woman was very nice .

    I am seeing a a counsellor in the week so this is something else to add to my worry.

    nation helpline advised me the same as you that cabot probably bought my debt for a fraction of the price... makes me wonder how many times this debt has been passed on.

    fingers crossed i will get this resolved

  • honestly cant remember.... been on loads of medication and issues to sort out so cannot be 100% certain..

    I am highly stressed.... do you think its worth sending a statute barr letter still or just admit i owe money and make arrangements

    If me I would probably send the letter to see what they come back with. If they should think a payment was made that prevents it being statute barred, then the onus is then on them to provide details and proof of it.

    I am going to library on Monday to print it off letter and then post them all off on recorded delivery.
    and wait for response.

    Clear start stated my best option was bankruptcy... that is def not an option for me. but will take advice from you all and not contact them again.

    a close friend stated that if at the beginning I made payments, and the debt gets sold on then my payments are void from the time its sold...

    I genuine have no idea of when and where etc of payment. i have a lot going on mentally atm arghhhhh

    if proven its statute barr then good if not well would creditors sort out payment arrangements.
    need to know to be prepared for the worse.

    Monday I was on verge of ending it all, but with hubby and good friends and advise from you guys are keeping me going
