Returning a faulty item when its not your name on the invoice?

Hi.. New to the forum so thanks in advance for your help.

Ok so my aunty bought a pram for me back in February from john Lewis.
Unfortunately she passed away a few weeks ago.
We have only just started using the toddler seat bit of the pram but have found that the harness seems to be faulty as my toddler slips out.
We are unable to register the 2 year warranty with uppababy as my aunts name is on the invoice not mine. They suggested speaking to john Lewis to a) get the name on the invoice changed so I can register the warranty and b) get the harness fixed as its only 5 months old. Because I have no warranty uppababy will not fix the harness. There is no replacement part available to buy, I would have to buy a whole new seat unit!

I called john Lewis customer services who would not speak to me on the phone as the details on the invoice are not mine.

I do have the invoice in my hand. If I go in to a store (65 miles away for me), do they by law have to do something about the fault as I have the product and the invoice or can they refuse as I'm not the origins purchaser.

Further more, at this late stage could I ask to return the whole package and get a credit note (I'm assuming they will not refund onto my card as it was my aunts card used to purchase) or will they only take the seat unit to fix it and return it. Its quite a long distance from my him (110 mile round trip) so considering just returning it as faulty and re-ordering everything again in my name so there are no more problems.

    They can refuse, you have no rights to a remedy at all.


    John Lewis are usually pretty good though so saying it was a gift and appealing to their better nature is the best way.

    As far as legal rights go with regards to the pram, I'm afraid that you don't have any.
    The original sales contract was between JL and your aunt as those are the only two parties who were involved in the sale.

    Instead of just turning up at the store, you might be better off writing to the head office of JL and explain the problem to them, asking if it would be okay for you to return the pram to your nearest branch for them to either arrange for a repair to be carried out or to see if they could issue a new receipt in your name.

    Did your aunt arrange a gift receipt and give it to you? If yes then that should allow the legal rights to transfer to you.

    Otherwise follow the advice above.

    Sorry to hear your Aunt passed away. Who is dealing with your Aunt's estate? Maybe you could ask them to provide you with a copy of death certificate and/or grant of probate. This might enable you to deal with someone at JL who is sympathetic, otherwise could you ask the executor of your Aunt's estate to write a letter for you to JL authorising you to deal on their behalf.

    Have you tried googling to see if there has been a recall? You could in addition speak to consumer direct.
