    Defended properly, there's no risk of you having to pay anything.

    But get onto the landowner in a big way too, if you can get them to cancel it or state they want it cancelled in writing, their case is completely sunk.

    I think that you are being too bullish with your choice of words. Whilst I agree with your support for appealing, let's not go down "there's no risk" route when clearly PE have had some success in the courts and, as things stand subject to the Supreme Court ruling later this year, a certain Mr Beavis DID lose in court and at the court of appeal and he was supported by a barrister.

    Unless you are personally going to underwrite any charges awarded by a court, then it is much more honest to say that there is every good chance and a better than even one that OP will not lose.

    But OP needs to read up a few cases on this forum to make an informed decision about their action.

    Me? I would fight it ! But only on balance of probabilities.
