Delivery wmpass

Options
I ordered a bed from a high street retailer and was told that it would take 5 weeks to deliver.

Got an email from the delivery company saying I can choose a day BUT they will give a a 4 hour time slot within that day. They say that either I or somebody has to be at the property to take delivery or I'll get charged storage and a re-delivery fee.

I can be there in the early afternoon but not in the morning. They say that they'll turn up between 8am and 6pm that's it..... period.

what options do I have?

Be there between 8&6 or be charged storage and redelivery.

Seems pretty straight forward to me?

Do you mean the delivery company are saying that if you're not in they'll charge you to redeliver & storage?

If so, theres no basis for this. You have no contract with them (presuming you didnt organise them yourself and its the retailers who did).

And unless the shop told you at the time of delivering that there would be storage fees etc if you weren't available, they cannot then add terms to that effect without your agreement - each party can only be bound by the obligations they agreed to accept at the time the contract became binding. After a contract is agreed, varying terms without your agreement is a unilateral variation offering no real protection or benefit to the consumer so would most likely be unfair (and thus legally unenforceable).

If you're on good terms with your neighbours though, perhaps you could ask one of them to take delivery until you get home. Or failing that, a friend/family member who wouldn't mind giving up a few hours to help you out.

Always best to avoid disputes when possible rather than arguing the toss later.

I think the OPs problem is that while they can choose any day they want, they won't be given details of the 4 hour delivery slot until nearer the time, probably the day before.

If the OP doesn't have one day of the week where they will have the entire 8-6 period free (and the delivery company will deliver) then it's a gamble.

Options? Go back to the retailer and tell them that this is unacceptable.

What's a wmpass? Did you mean impasse?

As other's have said, check the T&Cs you agreed to when concluding the order - do these mention storage and redelivery charges?

    Thanks for the replies eveeyone....

I've spoken to the retailer and they just give a (we've got you're money so we don't care) shrug. They pointed to the tiny print saying that the bed will be stored for 8 weeks at my expense then 50% of the cost of the.bed will be deducted plus failed delivery charges plus storage and if there is anything left that's my refund. The delivery company say the route is planned in advanced and can't be changed or deviated from. There is also no option to pay more and get a more suitable slot. I've said I can be at home from 12:30/1pm by taking the morning off but they said they might be there in the morning.

I bitterly regret buying from the so called premium company who seem to have a perminant rolling sale. Hurry ends sunday BUT Monday its the same sale but slighty tweaked. It then goes back to the original sale swapping between the 2. :(

    Yes, typing on a phone.

I made a big thing about delivery and the salesperson said fine not problem we'll work it out now they're I suspect going to hide behind the T&C's.

How the heck is that even enforceable? What if you were and the delivery company went to next doors who wasn't in and thought "Ah well, failed delivery" - surely you can't be charged by one company on the basis that an external entity does their job properly?! Fair enough if you've missed it three or four times then maybe look to charge a re-delivery fee but certainly not off the bat.
