Marks and Spencer refund problem

Hi All,
Last week a friend gave me a pair of M & S petite Sculpt and Lift jeans as a present.
Unfortunately they do not suit my shape terribly well.
Never mind, I thought I would ask to exchange them for something else.
I visited the Refunds section in Uxbridge branch on Monday. Behind the man serving me were details of the Refunds policy. As I did not have a receipt, I understood I would only get credit vouchers.
So I was rather surprised when he scanned the barcode, it came up with £9.99 on the display and he said that the item was non-refundable...
I pointed to the Refunds policy and asked why. Basically, he told me that anything priced ending in 49p or 99p was clearance stock and therefore non-refundable. He said it would not have made any difference, even if I had the receipt.
Yet I can't seem to find anything about this on the M & S website. Has anyone else had this happen?

Unfortunately these items are excluded from our usual 35 day returns policy, which is clearly stated when you purchase them. Your statutory rights are not affected.
However as you were not the purchase, technically you wouldn't have rights to exchange/refund even if it wasn't excluded.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

often they have a red dot on the label too to show they are final clearance
maybe you could ebay them0 -
I have bought jeans etc in Marks and Spencer at the very end of their sale. They tell you at the counter if its final clearance price you cannot return it.0

Thanks for all your responses. I will know next time (although I have to say I bought final clearance items Dec 2014 and no mention was made of it being non returnable).
