Do I ignore or dont I?

My wife and I parked our car in the entrance to a company at Doncaster Airport. The company I work for as a contractor has approved my parking on their entrance and so last night I did just that parking in their entrance and on a section where there were no double yellow lines suggesting parking restrictions. We sat for ten minutes during which time a camera enforcement van pulled up opposite us and sat watching for a few minutes. He actually parked the wrong way round with his full headlights on blinding on coming motorists and causing a hazard. He then drove off and came back. We hadnt moved from the entrance to the company during that time.

We sat there for 10 minutes before we entered the main airport carpark which is free for 15 minutes to collect my daughter from her flight. We spoke to an attendant in that car park who advised us that we will get a ticket for parking if the van was watching us. I therefore approach the camera van to be told that EXCEL Parking would be issuing a ticket.

I pointed out that I had permission of the land owner to park there and he said that didn't count. I pointed out that there were no yellow lines to indicate any parking offence - he said that didn't count I pointed out that parking in the offside lane of a dual carriageway in the face of oncoming traffic to video people parking was an offence and dangerous - he said he was exempt. I pointed out that they could not charge as I was there for 10 minutes and their company could not argue loss of income from any car park as they are all free for 15 minutes - He said that didn't count . I asked him if he could confirm whether he had obtained photographs of us parked on private land as this might be in breach of the DPA 1998 if they have no lawful authority to obtain and retain data (video) - He said "what?"

I thought Id keep it simple and pointed out that as a former head of roads policing he was factually incorrect in pointing out I was parked illegally - breaking the law himself by the dangerous way he parked - trying to enforce parking restrictions that he was not entitled to do on land he had no authority to be on - he said I was picking on him :cool: and drove off.

I have not contacted the company as they have a terrible reputation from posts made online about them. The spot we were stationary in Ive photographed and clearly shows no yellow lines and the entrance the company. I have since been given independent but contradictory advice. Do we and others from Doncaster using the airport:

1/ Ignore all letters that arrive full stop - these are not fines they are invoices and I have no contract with his company as the land isn't theirs - there are no yellow lines
2/ When we receive the ticket send it to the company whose land I was parked on and they will stop the process. I will not disclose any information to the company other than the ticket but I do not have complete control of this. They have offered to sort it. However, I believe Excel will continue to push and threaten at which point I will just ignore.
3/ Appeal it expecting not to win the appeal as rarely this seems successful but hope that actually it puts them through some pain as I find their practice corrupt.

    1/ Not current advice any more. I wish it was... Although you don't have to pay you can no longer simply ignore. Ignoring can by default get you a CCJ. Get in early with an appeal and you can prevent it going that far.

    2/ Maybe but don't ignore. Write to both the PPC and the owner of the land.

    3/ You'll win don't worry about that. Appealing is now just a stupid formality. Your appeal will just about always be initially dismissed then you go via what's known as POPLA and appeal again.

    And PPS remaining calm is the best way.

    Only ignore if you are posting from back in 2012.

    Not with Excel you won't, no PoPLA, just the IAS kangaroo court.

    Opinions are divided on whether to appeal. The options are:

    - Ignore. Very unlikely anything further will happen beyond a string of stroppy letters.

    - Appeal to Excel to show that you are being reasonable, but include wording to say why you will not be using the IAS (i.e. it's bent, but I've got some better wording for it if that's what you want to do)

    - Appeal to Excel and then, when they reject, appeal to the IAS (the theory here being that IAS adjudications are so flawed and biased no-one would dare put one in front of a real court).

    its the thread "stuck" to the top of this forum (there are maybe 4 or 5 of them) and are essential reading for the uninformed average joe punter who knows little about this topic and they contain a wealth of knowledge built up over time , like a reference library

    all forums have them

    one has the word NEWBIES in its title , that is the one referred to above

    so at the moment its a few threads above yours
  • Well good news - (I think) - The owner of the land has stated that he will inform Excel that the stopping on his land was authorised and that the PCN (if one comes) should be cancelled. Interestingly the land owner has banned Excel from entering their property because of their tactics.

    but .... yes there is all ways a but ........

    carry on until you get confirmation .... As some PPC's can/do carry on aay way :eek:

    carry on with the appeal .... try and get a chance to appeal to the kangaroo court .........

    if , if ... it worked out well you would be nice to get an IAS appeal refusal before the PCN was overturned by the land owner and cost them £££ :D

    Be sure to get this in writing from the landowner - as PPCs often don't play by the rules - they are a law unto themselves.
