I am looking to buy a Nissan Qashqai +2. I viewed a lovely, great driving 2011 plate at £9100 and...just before signing the dotted line...decided to click on the eBay HPI check at £8.99 mainly to find out whether there was outstanding HPI or stolen.
The check came back TOTAL LOSS INSURANCE WRITE-OFF despite the lovely couple having produced 2 years major company insurance evidence to me! They claimed to be unaware of any insurance claim/loss...I believe them!
I phoned my insurance and got a blanket quote....MANY insurance companies were happy to quote and take my money. I asked if it made any difference if I had found out that it was a WRITE-OFF. All companies said that they would NOT PAY OUT if I susequently made a claim
HAPPY TO TAKE MY MONEY but will NOT pay out in event of a claim!!!
This is surely an insurance scam!!! They all told me that it was up to the seller to advise me whether it had been a write-off....but they WANT to SELL their car!?!
The recorded messages say "we consult other insurance companies to avoid insurance fraud...etc"...so THEY MUST KNOW another insurance company paid out and the CAR SHOULD BE BLACK-LISTED!!!
UNFAIR...SCAM INSURANCE COMPANIES...GET YOUR ACTS TOGETHER!!!

You need to find out the category it was written off as.

Category C & D write offs are able to be repaired and put back on the road no problem.

Whoever told you that insurers invalidate your cover if you claim on a previous write off (c or D) is mistaken!

Cats A+B mean the car cannot go back on the road again, C+D mean previously writted off, have been repaired and hopefully VIC checked before being put back on the road.

I know some insurance companies won't pay out on a car that has already been subject to total loss pay out already-but will insure you! If buying an ex cat C or D and you intend on only having 3rd party only it's not a problem really.

It is down to the buyer to carry out a check in my eyes, you can do it by text for as little as £3!!

I had one of my previous cars 'Written off' twice; got paid both times by the same insurance company. So I ended up being paid more by the insurer overall than I had paid for the car and the repairs which I did myself. With a more expensive car though you obviously do need to be careful because the insurer may scale down any payment due to it's value being reduced by having a write-off history. Make sure you get a big discount on the price you pay.

also bear in mind the re-sale value of a cat c/d car, it will affect not only the price but put some buyers off altogether...

Calm down! It could be an innocent mistake in which another Insurer has registered the car as Cat A/B/C/D. Insurers very rarely conduct full checks when quoting, rarely when a policy is taken out and only sometimes when a claim is made. In fact the only search your Insurer is likely to carry out is a soft credit check.

The couple selling need to clarify matters with HPi and their Insurers - my betting is incorrect HPi information.

I'm a little puzzled about a few points, if the OP could help me please do.

    1. Have you actually viewed this car or are you purchasing off eBay ?

    2. What exactly constitutes "23 years major company insurance evidence" on a 2011 vehicle ?

    3. Why are you seeking insewerence quotes on a vehicle you have already discovered to be a (so called) 'write off' ?

    4. How many insewerence companies did you ask "if it made any difference if I had found out that it was a WRITE-OFF" ?

    5. Why did you feel the need to ask more than one?

    6. Who took you're money then claimed they wouldn't pay out?

    I could go on . . . & on . . . & on.

I could show you a company policy thats older than me, doesnt mean that car is insured on that policy.

2011 car, how long have they owned it? when was it written off? What category?

Just because someone appears to be trustworthy you still have to make checks, i remember one of the police shows, they stopped a stolen car. The buyer had the paperwork from the seller and said she was a posh lady in a nice house etc. Turned out to be a mobility car and not hers to sell.

Trust nobody when buying cars, The guy could repair accident damaged cars as a hobby or a family member buys them and repairs them.
They use it for a while and then sell it as all good.

Fortunately the law sees things different to you.

Since the law requires material fact to be disclosed where not disclosing it could influence the buyers decision.

I thought a private seller didnt have to disclose if a car was a cat C/D unless asked??

That sounds like Uberrima fides which governs non-consumer contracts of insurance - it governed all insurance contracts until a couple of years ago, when the law that dated from 1766 was changed.

I thought the doctrine for private car sales was closer to caveat emptor it only requires the seller not to misrepresent by making untrue claims, rather than fully disclose.
