But if the homeowner were to take the same image of their house from the same spot, using the same type of camera and lens that the photographer used, then the image copyright taken by the homeowner would be theirs and not the original photographer's.
The original image-taker would not be successful in suing for copyright theft as it could be proved beyond all reasonable doubt that the same image could be taken by anyone at anytime without having to seek the homeowner's permission.
As for taking the image, then selling it yourself for less. That is exactley the way I'd go about it. In fact, I'd make sure to place the image on every photo-stock site out there jsut to hack him off.Never Knowingly Understood.
