Parking problems

3 months ago I moved into a new rented house and we're the only block in the street that don't have driveways, so we have a wee row of parking bays next to the start of our block, but they're constantly being used by others.

There are no signs to say they're private, so my neighbour stuck up a wee note to say it's private property, only for it to be ripped down and people using our spaces. I have resorted to putting notes under windscreen wipers reminding them it's private property and asking that they don't park here. Again they're tossed to the side and ignored.

What are my legal options here to get our spaces back? I live in Scotland so we don't have trespass laws, and whilst my house is rented, the other three are not.

Any advice is gratefully appreciated

  • Does sound like the houses need to club together and pay for decent quality fixed metal signs to go up there. Hopefully that will work.

    Maybe retractable bollards is another way forward - so you can all have the key to "your" bollard and use your space - but no-one else can.

    Are you positive that they are private? Have you looked at the house deeds to confirm this.

    If they are directly off a public highway then they may be classed as part of the highway so free for all to use. Check with the council

    I've always wondered about the mentality, or lack, of people who suggest or intimate that a criminal act is a course to take . No doubt they will claim it was in jest but I doubt that

    Yes I've checked and it's 4 spaces, one each belonging to each house in the order that the houses come in. It's the first thing I checked, and checked with neighbours. The 5th house in the row has a driveway so they don't need a space.

    Before I wouldn't have cared about scratches but I've just bought a new car and so far I've been blocked in, had to go in the passenger side and climb into the drivers side and had wing mirrors bent because of someone's determination to park in there.

    I'll try proper metal signs and see if they make a difference.

    Amazon do some reasonably priced parking bollards that could be installed in each bay.

    If you are sure that the parking spaces are yours I'd definitely invest in a folding or retractable bollard.

    Did you check the deeds though ..what people "think" they own and what is actually owned are two seperate things. My parents have had issues with both neighbours trying to encroach on their legally owned land because the neighbours thought the land SHOULD belong to them (but actually doesn't).

    Sighs in recognition:(. People can indeed assert very "authoritatively" that they own land they don't - just because they want to own it.

    However, presumably Land Registry has these spaces down on Title Plan of each house and thus OP is certain of this - because they have seen that LP evidence.

    ^^I've had this before. Some new people moved into a property, and decided to paint a number on what everyone had previously been told was visitor parking. I continued to park there, and got a note on my windscreen. I went round and explained that paint doesn't equal ownership. They said the housing associated has told them the space was theirs. The HA also wrote to me, but were never able to provide the deeds I requested from them.

    Yes, I've been to the council to check this because I didn't want to start a war if I was wrong. And speaking to the other three neighbours, sadly this issue crops up every so often. It's the daughter of a neighbour in another street that keeps parking multiple cars there this time
