What does the OP think?

Presumably you have viewed the property you are buying? And have seen this buildibg which your solicitor is querying?

so - does it in fact cross the boundary? Is it on land which you anticipate owning?

Or is it jst a matter of a poorly drafted Plan, or indeed a Plan that is of such a scale as to be unclear?

Either there is an issue which your solicitor is rightly querying, or your solicitor is making a mountain out of a molehill, in which case tell him so!

Whether it is or it isn't doesn't prevent the vendor's solicitor from giving a straight answer?

The copy of the deeds and survey plan will have come from Land Registry so they won't be out of date and I wouldn't take the issue lightly as it will undoubtadly cause issues later on down the line either with the current vendors (considering they live next door) or more likely anyone that moves in next door in the future or when you come to sell. Your solicitor is right to bring it to your attention in my view.

Take the copy of the survey plan with you if you go to view again. Like I said before either get the boundries adjusted or ask for covenents/restrictions to be placed on the title deeds of your property and the neighbouring property to avoid issues in the future.

1) Go and look. Is there a boundary issue. When you go, take the Title Plan with you to compare the Plan with the reality.

2) seller owns both properties - are they on separate titles, or are they perhaps on a single Title which is being split in two? If so, there will be a Plan for the proposed split.....

3) have you downloaded the Title Plan (£3 here) for the other property to compare?

4) have you spoken to the seller? Or their estate agent? They can chase their solicitor. You can't.
