Paternity pay when facing redundancy

I am due to made redundant at the end of December and my partner is due to give birth at the start of January.

Can anyone advise on what I am entitled to (if anything) in terms of paternity payment?

I know there is the statutory two weeks but would I be entitled to share her maternity leave too.

All I can find online relates to if you get made redundant when already on paternity leave which doesn't really apply to me.

Any help would be appreciated.

    What exactly is it you want to do?


    You probably wont be entitled to anything as paternity leave cant be taken before the baby is born and you wont have a job by then

    Any paid paternity leave (or even sharing the maternity leave) is only paid to you if you are working.


    As you will be made redundant prior to baby being born, you won't get anything.

    According to government guidelines around maternity pay, if my partner is working for 26 weeks in a row prior to giving birth and she informs the employer 15 weeks before the baby is due she is entitled to full maternity cover even if she is made redundant within that 15 week period. Since 2014 paternity and maternity leave can now be split between a couple as decided by them.

    So my question is will I be entitled to get this shared paternity pay if my partner carrys on working after our child is born as this will happen within 15 weeks of me being made redundant.

    no I don't think so

    You must also:
    • have been employed continuously by the same employer for at least 26 weeks by the end of the 15th week before the due date (or by the date you’re matched with your adopted child)
    • stay with the same employer while you take SPL

    In order to qualify for SPL/ShPP you must be employed up to the start of the week in which your SPL/ShPP starts. If your job ends or you are made redundant during a period of SPL/ShPP, you remain entitled to ShPP up to the end of the period of leave booked (unless you start a new job). If the parent being made redundant wants to receive ShPP up to 39 weeks, s/he should book the rest of the ShPP period before their employment ends.



    But im not sure this will apply to you, as you wouldn't be able to start the leave until after you would have been made redundant as she has to take a minimum period after the baby is born,

    A mother can’t return to work before the end of the compulsory 2 weeks of maternity leave following the birth


    so unless your baby comes early...
