post popla appeal, any grounds for CC claim againt PPC?

Options
Hi
now that my Popla appeal has concluded in my favour, i wish to rack the brains of people on here, i have had a little search and found nothing that answers my question, soooooo.... has anybody actually carried through with their statement in the template appeal to the ppc namely the costs incurred part of the letter, and actually taking any PPC to court to claim costs incurred (time researching and time taken traveling out of your personal life to collate photos etc) further has anyone actually had any success with this? I have kept rail tickets as proof that I had to actually go to the site in question and take photos etc.
So anybody? Or is this just being cheeky! :A

A handful of people have tried. One or two people have got out-of-court settlements, probably because the PPC couldn't be rsed to fight it.

I've never heard of anyone winning a defended claim. In the only one I'm aware of that got to court the judge tore the claimant a new rsehole.

If they were acting as agent you have to sue the principle.
Three parties in an agent contract
    You
    The agent
    The land owner

The person contracting this agent is liable for losses caused by their agents.
I do Contracts, all day every day.
  • haha possibly being cheeky then. anyone else?

I have however complained to BPA concerning my case, as although my popla appeal wasnt actually won on my point of signage, I have suppied proof that they broke the AOS COP, due to said signage.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
