    If you appeal to IAS, you will probably lose. However, as their anonymous decisions are so flawed as to be worthless. it would be a very unwise PPC who proceeded to court if they thought that one would be seen by a judge.

    No independent appeal system, no case.
    You never know how far you can go until you go too far.

    Glad to have opened up a discussion anyway!

    Yes I've seen the various 'reasonable assumption' stuff from VCS in other threads - that's where this thought came from really.

    So as of the appeal to the PPC, The male/female thing hasn't been mentioned - so I fully expect the appeal to be turned down (though as a side note, the business/landowner have also appealed on RK's behalf, and there is also a potential problem with proof the PPC is contracted as the landowner recently changed). As you can see I've been busy and quite happy to push and push :)

    Anyway I got sidetracked.... should the male/female thing be mentioned at IAS, or kept quiet in order to drop that bombshell in court? (should I be able to convince RK to go the course I mean).

    Oh and finally if (when) the appeal fails with reasonable assumption mentioned, even though all the PPCs claim otherwise (decision final etc), can the RK not reply saying "Re: reasonable assumption - I am a woman, but there is a man driving on your photos. I assume the ticket is now cancelled?"

    Definitely put that forward to the IAS in order to check out how (im)partial they really are.

    In the highly unlikely event of this getting anywhere near a court, given the absurdity of the VCS argument, it will show the IAS up for exactly what they are.

    I wouldn't mention the gender, just that the RK wasn't the driver and the driver's identity won't be revealed, then appeal to IPC. See what happens next. If they state that they assume the RK is the driver then complain to DVLA/Trading Standards/Press perhaps. Certainly pass on the info on to the Parking-Prankster.
