Selling house privately

We are coming to the end of our contract with our estate agents, where would we stand if a previous viewer approached us with a private offer?

    There's probably something in your contract with the EA that covers this situation. The EA introduced the buyer so they still get their pound of flesh.

    The agent did their job by introducing a buyer. The contract almost certainly says you pay their fee.

    Oh - and don't even think of 'just not telling them'. Agents keep a close eye on who buys properties that are/have been on their books - it's public information at the Land Registry.....

    I think a contract I had not so long ago said that after 6 months of the contract expiring anyone introduced by the EA would not incur aadditional fees.

    It doesn't seem fair to me, I presume the agent put effort into marketing your property and even found your potential buyer.
    Not something I would do.

    You really need to read the contract you agreed to - they vary. But typically, EAs' contracts will say something like:

    - if you sell to somebody introduced by the EA within 6 months, the fee is payable to the EA.

    - You have to cancel the contract in writing (with 2 to 4 weeks notice). It doesn't end automatically.

    And there might be nasty stuff like withdrawal fees.
  • Thanks for replies, looked into the contract, it does state that even if we go with another Ea after our contract has finished, if a previous viewer ends up buying then we will have to pay original Ea fees.
