Was just wondering if anyone can help with this. Not sure if this is in the right place but I will give it a go.
Long story but going to cut it short.
Was involved in a court case, it ended and the Judge made orders that I do not agree with for various reasons. Therefore I went home and started to get an appeal together.
The court order came and the court order differs from what the Judge said in court. In fact I am fine with the terms of the court order and would be willing to accept them, I would have no need to appeal.
However as I say I know that the terms differ to what the Judge said in court, so therefore I know sooner or later the court order will change as it affects another party also.
First question is does anyone know if I will have to be summonsed back to court for the Judge to change the court order or will they just send an amended one through the post?
Second question, the court order has only just arrived. I have 21 days to appeal which ends in the next few days. Do I still need to file and pay for an appeal even though the court order currently does not say anything I want to appeal against? So basically Im appealing against a court order I have no problems with, even though the chances are the court order will be changed at some point.
Will the 21 days start again or will the time limit be extended once the court order is changed?
I will be seeing a solicitor tomorrow regarding this but thank you anyone who can help this evening.

If you're seeing a solicitor, that probably makes any replies on this thread redundant.
Otherwise, I would be inclined to acknowledge the court order in writing, with a copy sent to all parties involved, including the court.
My letter would acknowledge receipt of the court order [reference number] dated whenever.
It would confirm that I accept the terms of said court order, i.e..
I would then sign and date it, and send it to all parties by recorded/signed for delivery.0 -
are you 100% certain that you understood what the Judge said on the day you were in court?
Is this a final order? Is it within family proceedings?
I personally would be inclined to write to the court and explain the situation and ask whether the Judge can review the order urgently to either confirm that it is correct, and that you misunderstood, or to confirm that it is incorrect. Explain that if you understood correctly and the order is wrong that you wish to appeal and ask that the matter is clarified as a matter of urgency. It may be that in that case the cout could date any new order with the date it was corrected, so the 21 days would run from thenAll posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0
