Parking fine problem.

Hi People
I was wondering if anyone can give me some advice or their thoughts on what i should do, This may sound far fetched but i assure you its all true.
A little over a year ago i had a company car & i received a parking fine from the courts for just over £300 pounds ( £100 fine the rest court costs ) now i knew nothing about this parking ticket and the fine before it went to court & apparently neither did my company ( as they used to get all correspondents first as it was their car ) so i did complain to the court about this fine but was told basically tough i had to pay it because it has already gone to court.
I rang the court and told them that i could not afford to pay all in one go so they said i could pay in installments & i suggested £40 a month which they were happy with so i paid the first installment straight away. The following month i rang the court again & paid another £40, however by month 3 i totally forgot about paying them & before i knew it my company was phoning me up telling me that i had a court order put on my wages to pay this fine off in 3 total hits.
No problem i had not paid as i agreed so again i was happy with that & sure enough the fine was completely paid over the next 3 months.
Fast forward to just over a year later & i receive a letter from the same court telling me that i owe them £209 for an unpaid fine & have 7 days to pay before enforcement is imposed. So i ring the court & explain i have paid the fine and give them details of dates from my wage slips, they eventually agree the fine was paid by me but then tell me that they actually paid the money back to me 5 months ago into my bank account.
I then explained to them that this was impossible because that bank account was now closed because i no longer work for the company i did at the time of the fine & am now unemployed, after alot of talking they then told me that they actually paid the money back to the company i was actually working for at the time & that company have actually paid the money to the child support agency on my behalf.
Problem being that i have never had any dealing with the child support agency & have been happily married with 2 children for over 20 years & so told them this fact & they advised me to contact the child support agency to find out if i actually have any illegitimate children floating about ( of course this went down great with the wife ).
So i rang the agency & no thank god they have no record or account for me but told me that maybe it has been paid to them by mistake because other people at the company i worked for actually do have a account with them but because no NI number was supplied with the payment they actually cannot trace it back.
I then went back to the court & explained all this to them & those great words was mentioned to me " leave it to us & we will sort it out for you ", Fast forward another 2 months & low & behold a enforcement letter comes through my door for now £290 for the same fine. I ring the enforcement company & tell them the story & of course they have heard all sorts of excuses before & think this is comical & advised me to again to ring the court which is what i actually do again.
Wrapping it all up i have had to make at least 20 or so phone calls & have been told by my old company that they have to actually chase the money back from the child support agency & they will then pay the money back to me then i actually have to pay the court fine again. In the mean time have also been told by the court that if my company does not actually pay the money back to me then i am liable to pay the fine again.
So any help or advise will be much appreciated as i really cannot afford to pay this money again
sorry for the long post.

I have no legal knowledge at all.
In my opinion though, if you can proove you have paid them the money they are owed, the fact they have paid the money back or to somebody else is their problem.
I would email them (so you have a record) and tell them you spoke to them and they confirmed it was paid. Attach scans of your evidence and tell them that the matter is closed.
I think they need to get a CCJ before they can go further.0 -
Hi
Yes that is exactly what i was thinking but not according to them apparently & its the hassle/embarrassment of the enforcement people they are a right pain as you probably know.0 -
But you dont owe anything. Tell them to **** off.0

all though this started as a private parking issue ......I suggest a legal input is now needed .... consult a solicitor .....
and then read the newbies thread so as to not get into this situation again
good luck
