And whatever the outcome, let's hope the Consumers' Association then takes the legal action againt PE that Mr Butcher hinted at the end of proceedings:
We are relying on the Unfair Terms in Consumer Contracts Regulations. Of course, if we fail in relation to that, and indeed the respondents seem to be inviting it, we might well consider the issue of enforcement under the consumer protection regulations. But they are both potentially applicable and that fact does not in any way mean that the Unfair Terms in Consumer Contracts Regulation are not.
  • This happened to me. Went over by 4 minutes, went on holiday and by time I got back was over £100. Had used that car park 4 times over 3 months, never seen anything stating what the 'penalties' are.

Never been back to that car park or the shops around it. Stockton-on-Tees needs the business but tough, taken my custom elsewhere.

I hope you have let the shops concerned know your feelings ? ;)

Fermi, I really must take issue with you about all that stuff about being a board guide on one of the debt boards, what on earth has that to do with parking on private land?

Also, your piece in red seems positively libellous, are you sure that this applies to all such companies?

The first couple of lines are (I think) compulsory for Board Guide signatures. Check out other Board Guides - I think you'll find they have very similar signatures. ;)

(Did I say it is a signature?) :D

About as much relevance as being 'A fully paid up member of the Berkshire Hunt' :rotfl:
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
