Advice needed - Faulty Nexus Tablet

Options
Hi all,

New forum member here needing advice on my consumer rights I suppose.

I bought a Google Nexus 7 tablet (manufactured by Asus) from a retailer on Amazon (not Amazon themselves) in September 2013. Last month it stopped booting up - the details are superfluous, except to say that there are numerous stories detailing the same hardware fault on this model of tablet - all seemingly happening since Google updated the operating system to the latest version of Android early this year. Most people seem to think that a major internal board needs to be replaced.

I contacted Google for advice first, and they agreed it was a hardware fault, but accepted no responsibility and said I would need to approach Asus for a repair.

I contacted the retailer on Amazon who replied with the following:

'According to Amazon and our return policy which you can find on our Amazon's page we'll accept any return within one month ( 30 Days ) of the purchase.
As it was more then one month ( 30 Days ), which is exceed our standard one month guarantee with us you need to contact a manufacture directly.
'

I have also contacted Asus who wanted me to send them the tablet so that they could quote me for a repair with a minimum charge of £35 to cover P&P. When I filled in the online form to begin this process they emailed me back with the following:

'Dear Customer,

We have received the RMA application form with the SN: D7OKBC617958. The form
has been rejected because we cannot accept the provided document for warranty
verification.

Please be advised that as the manufacturer we do not sell any products to
retailers or end users. Our goods are sold by retailers, which are deemed to
be first point of sales.

The information provided advises the sales to be conducted between yourself
and an Amazon marketplace/ Ebay seller: ……

Websites such as Amazon Marketplace and Ebay offer a platform for end users
and retailers to trade, however these are not seen as official traders.

If not purchased directly from Amazon themselves, we are unable to accept the
claim you have raised with us for repair as the first point of purchase is
not confirmed to be an official trader of ASUS products.

Due to the above, we can only advise you to contact the seller to raise your
claim or raise your claim with Amazon/ Ebay.
'

I realise that my tablet is out of warranty, however, to me it seems obvious that there is some kind of inherent fault due to the number of people posting on forums as having similar issues, Surely I have some rights with Google, Asus or the retailer in relation to the tablet not even lasting 2 years due to the fault and therefore not being fit for purpose?

I have not raised the issue with Amazon yet and, as I purchased it with my credit card I could approach them under section 75.

Any advice would be much appreciated.

Many thanks, Paul.

You need to obtain an independent report indicating your tablet was inherently faulty, aka faulty at the time of purchase. Anecdotal reports on the Internet will not do.

You need to pursue the retailer on Amazon (not Amazon themselves) you have no contract with Asus or Google.

I try not to buy more expensive things through amazon marketplace, as I think the consumer protection is too hard to navigate/enforce
