Robinson Way - CCJ unpaid and Bailiffs visiting

Hello folks got a small issue with Robinson Way.

It's to do with a very small debt for £25 which was ignored (very stupid I know) the debt then resulted in a court claim which no defense was entered for which resulted in a default judgement.

The default judgement was ignored and now there is a bailiffs warrant that has been issued meaning that a simple £25 debt is now almost £125.

Before any of you jump to conclusions telling me how silly I have been please let me clarify something.

I invoiced Robinson Way as they were chasing me for a non existant debt and wanted proof that their client already held (that had been sent in twice before to other collection agencies) to be resent.

I did this and invoiced them and it was all binding as my initial communication was quite clear stating if they wrote asking for proof which had already been provided but they were basically too lazy to get out of filing then id bill them for my wasted time.

As you can imagine they laugh off the invoices and ignored matters.

Fast forward 4 months to them ignoring all the court paperwork due to the low amount and we now have a bailiff in attendance.

£125 is not much I know but its good to hit these parasites in their pocket for a change :)

    Well done

    I imagine at this stage it would be easier for them to pay up rather than try for set aside.

    I thought they might go down the set aside route but the invoice I sent is pretty tight. My standard opening letter to debt collectors is that if any requests are made for information or documents that are either originals in the control of their client or have been provided previously and are being requested to be resent shall be complied with but will be charged at the rate of £25 per hour or incident of contact.

    I always record my calls and ensure I give them an option when they call saying I will invoice them if they still want the documents.....usually met with sarcastic laughter telling me to go ahead and send invoices.

    Ignoring the invoice and the court claim they have a tough job requesting a set aside claiming the payment isn't due and they are entitled to file a late defence.

    I'd recommend others to try wording this into initial letters to collectors as to date I've gotten payments from RBS, Moorcroft, Lowell, Fredrickson and Metropolitan (subsidiary of HSBC).

    Did you sue the right firm as in as listed exactly as written at companies house and enter the company number on the CCJ claim form ?
    If not them that laugh last will always laugh longest.

    Yup sure did :)

    This court claim isn't my first BBQ so have learned all these lessons the hard way.

    bet they don't pay, court baliffs don't have much power
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    As R/W are HCEO's themselves, they know that if they don't pay ten the op can go to the HC and obtain a HC warrant and get it enforced by an HCEO. Which will cost R/W even more.

    Against a business loaded with computers? It did cross my mind that the op could do a 3rd party debt order and freeze their main account. But the court bailiff will collect here I think, unless RW do decide to try set aside and defend the claim.
