Hi Guys,

I had another letter come through from Debt Recovery Plus today (must be near the end of the chain) offering the discounted charge of £128 before they maybe make a small claim.

Does it really give you a bad credit rating if they take you to court?

Also, I was trying to look for information on how many small claims they take to court but couldn't really find anything post 2013.

Does anyone know anything about this? Have they taken people to court recently? I can't find the statistics.

Thank you!

If you are getting DRP letters, then your chances of going to court have diminished considerably - Because DRP can't do squat.

See Post four of the Newbies Sticky for all you need to know about DRP. The rest of the thread covers the info you need to deal with Smart if they do try anything further down the line.

    Was this England or Scotland?

Should have been more specific, it's the discounted charge given on behalf of Smart Parking before DRP recommend to them that they take me to court.

    I'll have a look!

    England.

DRP couldn't recommend their own rear-end!

And the "discount" usually means you are nearing the end of the change.

Smart don't do court often in England and Wales and not at all in Scotland, so as you are past the other deadlines, your best option is to sit tight unless you get a proper LBCC - then follow the advice here on how to defend it (Newbies Sticky), or take other approaches to see if the landowner/operator will cancel it.
