Napier notification letter

Options
Help needed!

I have moved house and changed my car since I received a parking fine, I forgot about it, never received a notice to keeper and have now received a notification letter from Napier that they are holding me liable for unpaid parking charges. They say I have 14 days to respond or the take me to court. They have enclosed a sample case from Milton keynes county court

I have no idea what to do now, the ticket was from back in May!

Help please.

more info needed, type of car park? residential? your own space? lease?/freehold?/rental agreement? other?

nothing useful can be added until you provide more information, other than don't panic.

Oh dear, you have chosen the wrong marine ...

As you appear not to have read the stickies, nor done any googling of this company, unless you are up for a fight against a very skilled opponent, my advice would be to pay it.

Well it does say I can appeal on their website, it says the if appeal not upheld then I can appeal to POPLA

So I have read the sticky but it says from very early was wondering if in my case it was too late. As I am confused by the wording in their letter. I think it's just scare tactics

that would be true if the appeal had been done in time, sadly I think your window of opportunity to appeal has long since passed (its usually 28 days from the NTK)

by all means appeal if you want, see if they accept the appeal or if they issue a popla code to you , if they say its too late, then its too late

in which case the EA 2010 may be useful in a counter claim, as mentioned above (plus as a defence to the judge)

ps:- its definitely scare tactics, but this company normally mean business and will go to court

The landowner in this case may very well be the de Savarys.

True - but by informing them, it puts the ball squarely in their court for cancelling this and not taking further action. :)

How would I find out the landowner??

Also they said I can appeal and then go to POPLA if unsuccessful so I'm assuming that's the case so what would I say to appeal do you think?

Ideas for you for finding out who the landowner is: Google the location, Land registry, ask at the shops, use the Search the Forum function on this forum using the location as a search term may find posts from others caught out there too.

Also where have they said you can still appeal? In their letter to you?

If so have a read of **NEWBIES!! sticky thread and look out for the blue highlighted 1st appeal template letter.
