CPM Parking Fines

Hi everyone,

After some advice. Received a "Formal Demand" from UK CPM today stating I need to pay them £100 for failing to pay a fine.

I was under the impression that they could not enforce these fines and alas never paid it.

Should I be worried/paying this now as they are threatening to send bailiffs?

    Yes yes yes, they will send the bailiffs round to your house tomorrow at 12 noon, where they will force an entry and remove goods to the value of £575 as you have failed to pay the fine.
    You will also receive a CCJ and will be unable to take out a loan, mobile phone deal or any other service that requires a credit check for the next 6 years.

    that's what they want you to believe - the above is all nonsense of course.
    just like your statement saying you have a fine. Thats nonsense as well, what you have is a speculative invoice issued by a private company, this is a completely different beast to a real council issued parking 'fine', all the information you need is in the sticky thread.

    first of all a few questions: where was the ticket issued? in most cases if you stand your ground and are polite but firm you can get the landowner to cancel the charge. parking companies are usually no more than agents acting for and on behalf of the landowner.

    Now onto more serious matters, you said they are threatening bailiffs.
    What paperwork have you had from the parking company, I'm guessing youve just had the threat-o-grams from the PPC and powerless debt collection company(s)
    if thats the case then it may be too late to take it to POPLA/IAS to kill it off that way however a landowner cancellation is still possible and maximum pressure should be applied to the landowner to achieve a cencellation.

    You may have received official court papers if so dont worry, the land owner can still step in and call off the dogs - again maximum pressure will/may be required.

    If you have a default judgement entered against you then things start to get a little tricky, you may be able to get a set aside to overturn it, however this will require a little effort on your part.
    If you ignored official court papers then things get a little harder, you may be able to use the now out of date BBC watchdog advise to make a paper plane out of the notice and chuck it away as a reason why you ignored everything, and its not been unknown for some of these PPCs to use fake court papers, and you may have an angle there, however if you are at this stage then it will require a little more effort.
    Either which way take a read through the sticky thread at the top of this forum
