Hi ALL,
I am new here and would like to say hello to everyone.
I have received a letter today ( cant attach links nor pictures yet) from ParkingEye about overdue staying and parking charge.
I was reading a lot of threads in here , and figured out that the first step i should take is to send them an email contains the Coupon Mad from -NEWBIES!!! [Sticky Thread Comments Archive] blue text ?
Would that will be the correct way of dealing with this ?
Many thanks in advance for any help

The NEWBIES guide is what needs to be followed to the letter
Don't divulge who was driving.await NTK (unless leased or hire car) soft appeal to PE, rejection, then win at POPLA if you follow the rules.REVENGE IS A DISH BETTER SERVED COLD0 -
Thanks Northlakes
I do exactly as you saying , I will send them an email contains blue text from NEWBIES thread and see what happens . I’m guessing will be rejected
Shall I also attached pictures from the car park with no clear signs by the entry to the car park ?
cheers0 -
Your soft appeal to PE will be rejected anyway so you don't need to try hard. Save your photos for the POPLA appeal later.
Don't forget to complain loudly to the retailer you visited. This can be very effective and less troublesome.REVENGE IS A DISH BETTER SERVED COLD0 -
ok, thanks.
sorry one more , I was there on 31/05 and I get this letter today so it’s like 45 days now since this happened . Reason for that was that I have bought this car and they have get the previous owner details from the DVLA . He replied to them with my details .
shall I mention anything about this ? that was sent very late to me ?0 -
In theory it's out of time for ANPR as the keeper is supposed to be notified in 14 days and presumably the previous owner was?
There may be a provision in POFA 2012 for this type of case and more experienced poster may know the answer straightaway but I will have to have a look at that.REVENGE IS A DISH BETTER SERVED COLD0 -
Providing your name was received by the DVLA before the date of the PCN you might be OK.
Here is the passage from POFA 2012,
(5)The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.
(6)A notice sent by post is to be presumed, unless the contrary is proved, to have been delivered (and so “given” for the purposes of sub-paragraph (4)) on the second working day after the day on which it is posted; and for this purpose “working day” means any day other than a Saturday, Sunday or a public holiday in England and Wales.
If the DVLA have failed to process that information on the PCN date I think that might be PE's problem.
In POFA I can't find any exclusion from the 14 day rule apart from a hire vehicle.
Others are more knowledgeable than me but I would state that the NTK was received out of time for the keeper to be held liable and that they need to contact the driver. You are under no obligation to name the driver.
See what others think.
If PE reject your appeal come back but whatever you do follow the procedures in the NEWBIES thread and don't inadvertently divulge who was driving.REVENGE IS A DISH BETTER SERVED COLD0 -

Thank you for contacting ParkingEye, we acknowledge receipt of the appeal.
We endeavour to respond to all appeals as soon as possible. Whilst we consider an appeal the parking charge amount will not increase. Please note that a full written response may take up to 14 days.0
