online order not delivered,costs incurred

hi,hope someone can help with this.
I ordered a 5.6 metre RSJ online which came with free delivery.It was ordered and paid for by credit card on 30th June 2015.
I had an e-mail saying it was dispatched on fri 3rd july for delivery on monday 6th july.
After contacting the seller because the rsj did not get delivered i was told it is with the courier.
I had a builder booked for saturday 11th july as i was assured it will be here by sat morning.
It is now Tuesday 14th july and apparently it is still with the courier and still out for delivery.
Ive had to pay the builder for his wasted time and he will not return until the rsj has been delivered.When i call the courier i get told to contact the seller.where do i stand on this ?
can i cancel the order and get a full refund,and can i claim back the money i had to pay the builder ?

    Key here is what what was the contract for delivery ,#Free Delivery usually means within xx days or weeks .
  • nothing in their t&c stating delivery times.I was just told via email when the delivery would take place

    Was the rsj cut to your specification?

    You can only claim back the builder's money if there was a guaranteed delivery date agreed, or you had specified that time is of the essence.


    Frankly, I think you were a bit hasty getting the builder there before the steel was onsite... but hindsight is quite useful.
    We see so many threads on here about people throwing out three piece suites the day before the new furniture is due, and then having several weeks with allegedly nothing to sit on.

    And why did you buy the RSJ? Why didn't you get your builder to do supply and fit. If he buys steel regularly he will have a working relationship with his suppliers, rather than relying on internet companies. I think you need to accept some responsibility in this.
    Eat vegetables and fear no creditors, rather than eat duck and hide.
