For arguments sake...
Lets say i accepted the repair, I must still be entitled to compensation at least for the emergency repair of the vehicle. Not taking into account the added site fees and lost wages.0 -
I have just got off the phone to my local renault garage and they basically said in no uncertain terms that if i can get a refund for the vehicle i should get shot asap.
The "approved" repair for this fault (which is a well known fault) can run into the thousands.
I may need to become quite forcefull for a refund which in not something I am particularly good at or capable of :S0 -

Oh well, that rules out any Section 75 claim route. (If you'd used a CC then you may have had a route to recover ALL your monies, not just the £1500).0

The £1500 was a personal loan to buy the vehicle because the dealership didn't offer finance and cant accept finance customers as he doesn't have a consumer credit licence.
So i got a personal loan to pay the £1500 and used funds from the sale of my old car to cover the other £5000 -
Beginning to get concerned because i still don't know what i should do.
I believe he will be offering the car back on tomorrow / friday and i don't want to accept it back because that would mean that i legally accepted the repair.0 -
Ah ... so it WAS finance that was used? Did you specify, when taking out the loan, what its purpose was? (If yes then this marries the loan to the vehicle purchase, and so Section 75 should apply).0

Yes I did specify the reason for the loan, however the reason doesn't seem to be on the agreement documentation.0

The ''Warranty'' is only on top of your rights as a buyer under SOGA so I wouldn't look too much into that unless it's a paid for warranty
The second point is the dealer has the right to see the vehicle and fix the problem and you can't ask for money to pay for work that was done without their knowledge.
Just out of interest who would you blame if the ''Emergency'' get you home repair failed and caused more damage?
And one more thing, don't DEMAND anything. Be strong and too the point0
