Smart Parking - Fistral Beach Nightmare

So, I went with my boyfriend to Fistral Beach, advertised as 20 minute grace period on the Newquay Voice. Little did I know the company had changed.
I had problems with my car, due to a damaged bumper and stopped to reload the bumper with further sticky tape, as the car kept stalling
My boyfriend checked the parking times and we decided we didn't wish to park there, so we left. We were in the premises for 16 minutes and 40 seconds. (Would of left earlier if the car didn't stall so much :mad:)
2 weeks later I recieve a Smart parking fine of £100, £60 if paid earlier, so I call the owner to confirm the grace period, questioning why it is advertised at 20 minutes, he said it was 15 minutes only, and Smart parking (in the terms and conditions which take around 10 to actually read) have stated it is 10 minutes.
I have appealed on the grounds that the parking fine does not justify the amount of time I went over the grace period and have offered to pay £10 to cover a cost of an hours parking and another car parking for the limit of 5 hours.
Does anyone know what I can do about this? I have never heard of such a con where you are charged for 16 minutes worth of parking? And the fact the owners info actually contradicts Smart parking is another cause for concern! :mad::mad:

It is not a fine, it is a speculative invoice.
Start by reading the Sticky thread for NEWBIES at the top of the main page. This is your one shop stop for all private parking queries.
It's a shame you didn't come here before you sent off your appeal as it appears that you have revealed who was driving so you have thrown away one of the main winning appeal points by doing this. Check the appeal template in the NEWBIES thread to see what points you should have used to appeal.
When you get the rejection notice (your appeal is bound to lose) it must contain a PoPLA code. If it does not, complain to the BPA and DVLA. If it does, find and modify a PoPLA appeal that is similar to your case and post it up here for the experts to check before you submit it to Smart Parking.
Use the search facility and keywords Fistral Beach/Smart Parking, and also check the POPLA decisions thread at the top of the main page.
Include all the appeal points except no keeper liability (unless you didn't appeal as driver which sounds unlikely). In other words, poor signage, no standing, not a GPEOL.
Read and re-read the NEWBIES thread until you understand what you need to do. All the acronyms are explained in the aforementioned NEWBIES thread. I'm not sure if the new signs mention a change in the grace period, I can't access the pictures of the new signeage today, but have posted them on this forum recently.
May also be worth speaking to Chloe Lyme at radio Cornwall (she's on facebook.) She tells me she's spoken to SMART who have told her that they have now reverted back to 20 minutes grace.Illegitimi non carborundum:)0 -
