LOL just what I was thinking.
There's far too much reliance on witnesses... I'm not so sure they are better than nothing on some occasions, and you never know which, plus there's the added issue of the witness being nothing of the independant sort.0 -
Morning

Feel quite stressed about it all this morning ahhhhhhhh deep breath.
Thanks for the replies so far, just confirmed they are indeed shut until tomorrow morning, I am really surprised about that, never had to claim before but sort of expected I would ring them they would send a local repairer today to collect it and drop off some god awful courtesy car, better than nothing, I have no idea why I expected that I just sort of presumed that was the way it would have happened, which then makes me think well what would have happened if the car had been un-driveable and I was stuck at the side of the road???
Also, quite unusually for me I did not do any research on them before I bought the policy, this was because I had other products from them years ago and my dear old Mum has had all sorts of insurances from them over the last 5000 years or so, so I already had trust in the brand so did not think it was necessary to perform due diligence so to speak, pffufffff how wrong was I? On reviewcentre they have a rating of 1.4 out of 5 with 179 reviews, the majority being hugely negative and some of them really shocking, so all this is now adding to my stress levels as well
Anyway I need a car ready for school run tomorrow, 22 mile trip either way no buses! So this has left me with no option but to look at other way of getting the ball rolling, I need some advice on this though because I ave never heard of this kind of thing, I found them on the net a company called easigo
http://easigo.co.uk/
What do you all think, sounds like just what I am looking for but do not know if it is a good idea or not?

Well if you're sure the other party will take the hit. Another one is freemotorlegal.co.uk0

The key to getting a car for tomorrow is to keep it simple, and keep it local. Hire a car from a normal hire car place for one day, just to get you mobile and then see what the insurers say tomorrow (Monday).
You expectations about your insurers keeping you mobile are understandable, but wrong. They insure your car, and if you've paid them to, they offer other related services, too. I don't think I've ever heard an insurer claiming to keep you on the road "whatever happens", and I don't think they could.
Welcome to the world of the insurance claim. Your frustrations are not over yet, so be prepared.

Here's a previous thread about easigo.

Bear in mind they will not take your case on unless you have a clear cut case otherwise they will want to wait until Monday afternoon to allow them to check with the other Insurers that they accept liability.
Roughly what are the circumstances of the accident?0 -
I don't think so, I think it will be one of those where the lady in questions thinks she did nothing wrong, genuinely lovely lady we are a small knit community around here so I know of her, bit for me she did, she was basically pulled over to the side of the road, at first I thought she had stopped but when I got nearer I could see she was going very very slow, about 5mph at most and pulled into the side of the road, I was very cautious and weighed up the options, this is a 60 mph 2 lane country road houses on the right we are obviously travelling on the left.
I slowed right down to around 15mph she was still a lot lot slower and importantly pulled into the side of the road, I assumed she was either having car trouble, or was pulled over from a distraction or something or just needed to stop, so I signalled to overtake nothing coming the other way great visibility, I began to to speed up and overt take leaving loads of room nothing coming the other way, as I am pulling levelish with the back of her car in a split second she had put the right indicator on and was trying to cross to the other side of the road where the houses were, no time to react speed was up to 25-30 mph she literally switched the indicator on and began to move over sharply at the same time. My passenger side front corner ploughed into the drivers side rear quarter panel area and pushed her forward a bit till we stopped.
After I got out to talk to her 2 people appeared from inside one of the houses, they heard the impact and brake skids but did not see the accident, I obviously first off made sure the lady was OK and not injured, she was fine a little shaken, she had not even seen me so it was a complete shock to her. I explained what happened and she straight away said " I had slowed down as I was looking at the houses on the right to find one that I need to go to, I have not been here before and was trying to locate the house, when I saw it I pulled over and you hit me mmmmmmmmmmmm I said almost immediately this is not my fault but then decided it was best to just leave it to the insurance companies to sort out.
The reason I overtook is because she was pulled so far in to the side of the road, had she been towards the middle of the road where you would be if you were looking for a house on that side I would not have overtook, so it is a bit dubious really, I know in my heart of hearts this was not my fault but not sure how the insurance companies will see it.
I think she was concentrating so hard on looking right and finding the house that she "drifted" over to the left hand side of the road without even realising, she was going so slow as well, literally 5 mph at most, she will have been looking for house names on a small row of cottages, nightmare to find when you are stood still! Then she has located the house, checked nothing is coming towards here and then bam off she went without even looking behind her, I was there in both rear view and side mirrors she would have seen me had she looked so I know it was not my fault."You can measure a man's character by the choices he makes under pressure"Sir Winston Churchill0 -
The liability (Fault) of the accident is not as clear cut as you imagine and a lot will hinge on what the other party describes as her description of what happened.
Both parties in an accident tend to describe the circumstances of an accident differently especially once they've spoken to a friend who tells them they were not at fault and coaches them on what to say.
Have you spoken to the third party since the accident and if so are they accepting they were at fault (Ultimately her Insurance will determine whether she was at fault or not but her accepting fault can be a great help)0 -
No I am going to give her a ring now and will report back soon,"You can measure a man's character by the choices he makes under pressure"Sir Winston Churchill0

engaged should imagine she is on the phone to her insurance company, will keep trying"You can measure a man's character by the choices he makes under pressure"Sir Winston Churchill0

I agree. A lot will come down to how convincing the other party is, whether there are any discrepancies between your versions of events, how narrow the road was, exactly where on the road she was positioned... all sorts of things.
Based on the story so far, I could see it being 80:20 against the other party. I think many experienced drivers would probably at least warn another moving vehicle of their presence on the road before overtaking. The issue for me is that her vehicle was moving. If it had turned from stationary, into your path, then it would have been more clear-cut. IMHO.
But as the person who coined the phrase, I will add: this is not going to be CSI Country Lane. The scope for thorough investigation in a no-injury incident is limited. If there are serious differences in your versions of events, expect it not to be fully no-fault.0
