Car purchase enquiry - HELP NEEDED

Hello,

I bought a car today from Evans Halshaw. It is a used car and cost a shade over £2200. I paid in full today using a debit card and credit card.

The salesman advised that there was no way at all that they could reduce/knock down the price of the car as the prices were set by computer. I reluctantly accepted this and paid the price advertised.

I have since checked the website and the car is still being advertised, but at a lower price of just under £2000 (even though I have bought it!!)

Obviously I am not happy about this as I could have potentially saved myself over £200.

Can anybody advise me if there is anything I can do? To me it appears that there are possibly 3 options.

1) contact the dealership tomorrow for an explanation and request the difference be refunded to me under their policy that if I find an "identical" car cheaper within a 40 mile radius that they will refund difference.

2) If not happy, I can return the vehicle under the 30 day dealership guarantee, get a refund and buy the car again at the lower price.

OR

3) utilise the 14 day cooling off period after signing the contract and request a refund then buy the car again.

I have taken screenshots on my phone of the reduced price for evidence.

Can someone advise please what they think my best option is or if they have any ideas.

Much appreciated.

Option 1 seems to be the answer ... and you have found an 'identical' car!

What's this 14 day cooling off period you speak off?

Under the t&C of the contract there is a mention of a 14 day cooling off period (as I think there is when you buy anything that you sign a contract for), however the t&c's are so complicated looking that I could be wrong. I guess I will just need to wait and see what happens tomorrow when I speak to them. No doubt they will have an answer to explain everything (in their favour of course).

The 14 day cooling off to pay by finance? You still need to pay for the car you bought.

Not seen a 14 day cooling off on returning teh car though, a price guarantee but nothing else.

They will probably put the price drop down as an admin error, Price altered instead of being removed.

30 day offer seems to be an exchange vehicle not a refund.

Quote from their terms and conditions.
All cars come with a free 30 day guarantee, all are data checked and given a comprehensive Evans Halshaw health check. Same day delivery can be arranged and you even have 30 days to exchange your car if you are not happy with your choice.

No you don't automatically have a cooling off period when signing a contract!!!

    Just a quick update folks.

I received a reply from Evans Halshaw this morning and they have advised me that I will be refunded the difference in cost between what I paid and the newly advertised price.

    Thanks for your input.

Keep checking their website to see if they reduce it in price again

Well spotted In2deep and well one for sticking to your guns.

As has been alluded to earlier, their is no automatic cooling off period at all when purchasing anything. When a consumer makes a purchase, they are entering into a contract (that is irrespective of whether it is a packet of crisps, or the purchase of a car with a multi-paged signed contract) and it is the individual terms and conditions of that contract that are pertinent.

And to quite the seventeenth rule of acquisition: A contract is a contract is a contract. :D

Let's not forget a small round of applause to Evans Halshaw for doing the decent thing. Not all second-hand car dealers are villains!
