Hi , i had a parcel delivered to the post office which they refused to accept and sent the item back to the sender on the 7th July, however the item still hasnt gone back to the sender and they wont send a replacement untill they recieve the item back.
But royal mail are saying they know the item is on its way back to them so they dont have to wait for the item to come back before sending another one out.
Who is right?

Can you please clarify, how did you have a parcel delivered to a post office if you are not a seller, why did you have the parcel in the first place, is it a return or something?

So was the address of the post office the one in your order and is there tracking of any sort that shows there was an attempt at delivery?
Consumer laws would still be in your favour if tracking shows item refused, however, a company may seek to fight this if they believe that you were using an address that you knew would not have accepted a parcel. In that instance it is likely that although you would get a refund you may have to wait for it, as even fighting them through a card chargeback is going to take time.
Incidentally do you have an arrangement with the post office as if so you would need to take this up with them as them, can't refuse a parcel for you if you are in any sort of scheme where you pay them to do so.

Businesses can opt in and customers can select that option if it's offered. They can't just give the post offices address which it would seem to suggest, otherwise the PO wouldn't refuse it (unless it was an inappropriate size to be stored)0

The parcel is still at the retailers risk if it hasnt came into the possession of you or something authorised by you however there is nothing in law forcing them to send a replacement before receiving the other one back. There is law covering distance sales where the contract should be performed within 30 days unless agreed otherwise but all that does is entitle you to a refund - not to a replacement.
If you'd put your own address and no one was home, the postie would have returned it to your local PO depot and put a card through your door. Possibly wouldve been delivered to neighbours but as above, the company would have remained liable until it came into your possession. If you wanted to avoid this, you could also send the retailer instructions not to deliver it to any address but yours.You keep using that word. Amazon allow deliveries to be delivered at nearby places for you to pick up at your convenience. Sometimes that's a post office. The post office won't just accept parcels on behalf of others though - though you may actually be able to have them delivered at the local head office depot.0
