Norfolk Parking Enforcement CCTV Charge - HELP!

Hi. I'm a newbie on here, so apologies.. My wife recently received an initial demand for £60 from NPE after I parked (morally wrong I know) in a disable bay on a Private Car Park to collect a Pizza. I was driving, she wasn't. In light that ignoring a Parking Eye request a couple of years ago and never hearing anything further, we started the ignore tactic with Norfolk Parking Enforcement, but further investigation makes me think that this should not have been the case, because it's now July 2015, that we should have approached the situation differently. The invoice was issued via CCTV.. Norfolk parking enforcement are BPA members and CCTV / ANPR are covered as part of their practices. We've just received the second letter demanding £100 having not appealed or entered into any correspondence. I believe it's too late for any type of appeal and I really could do with some assistance to know the best course of action to take.
The second letter arrived yesterday stating £100 is now required, which will rise to £150 if not paid.. Or for Driver details to be provided.

stop worrying , have you recieved full time stamped photo,s ? I am still working out how a ANPR system can differenciate between a blue badge being displayed or not.
the photo is more likely to have been taken by "shady fred" using a samsung galaxy phone , whilst riding his pushbike!

The image was definitely taken using CCTV from a height. I returned to the site and had a look. The car park had numerous spaces and whilst I appreciate the moral aspects of parking in a disabled bay, there are no legalities surrounding parking in such a space on private land. I understand that it may as well be graffiti. Is there any way of uploading images onto a post?0

I'm glad you realise what you did was morally wrong. You deprived a disabled person the use of a concessionary parking bay provided for them by law.
What was the alleged offence on the PCN? Did it say something like parking in a disabled bay without displaying a BB (not that BBs are valid on private land as you also have surmised). If so, what evidence has been provided? If the photos are ANPR pictures on entry and exit, they cannot relate to where the car was actually parked so do not prove anything other than your car entered and exited the car park.
You could appeal to the PPC anyway but they will no doubt say you are out of time and not provide a PoPLA code, or you could name the driver to reset the clock and appeal using the template in the NEWBIES thread but modified to exclude keeper liability and POFA 2012.

I appreciate the moral aspects of parking in a disabled bay, there are no legalities surrounding parking in such a space on private land.
Presumably you also appreciate why landlords welcome PPCs onto their land and why every year millions (literally) of motorists, who have never flagrantly misused parking spaces, are hounded by threatening letters - just like you are now.
You won't get any sympathy here for parking in a disabled spot when you had no entitlement.
No, it's not graffiti (unlike for parent and child places) - there is a legal requirement for the provision of additional adjustments for those with protected characteristics under the Equality Act 2010. The fact that landowners mark such adjustments fairly consistently throughout the country (yellow lines and wheelchair depiction) is their method of trying to comply with the Act.
By the way, you mentioned ignoring a ParkingEye PCN from around 2 years ago? They are the most litigious PPC in the country - 30,000 court papers issued last year - you haven't by any chance changed address since the PE PCN issue?Please note, we are not a legal advice forum. if this is dereham road (like alll the others), some people are saying they are using CCTV and not ANPR
perhaps the OP should read the other recent dereham rd threads, if its the same place ?0 -
This is not Dereham Road. This is the camera at St Augustines (The old swimming pool car park behind the spar shop / Dominoes Pizza / Chinese that face onto Aylsham Road)0
