"going there anyway" delivery service failed

to cut a long story short I used a website to have a sofa moved. The website allowed me to post the job for drivers to bid on the delivery.

I accepted a bid from a driver who collected to the sofa without a problem however instead of delivering the item properly he just left it in the front yard. The area is dodgy and unsurprisingly the £150 footstool got nicked

Looking at the terms and conditions for the drivers on the website they agree to let the website collect payment - they take 10% and agree to get a signed delivery slip and allow the client to sign off for no damage before getting the other 90%. Instead this guy asked for all money up front and instead of getting a delivery slip signed he dumped it and !!!!!!ed off!

The question is... who do I ask for a refund? Is it the driver himself or the company who connected the two of us through their bidding system?

    You paid the driver directly before he had delivered the goods? Is that right?

    If so, it is quite clear that it is the driver that you should be looking to for a remedy.

    I am not sure a refund is appropriate, after all be did deliver the stuff. I think you should be seeking compensation for the loss of the footstool due to his carelessness.

    Be prepared for the answer "what footstool"? when you ask him about the loss. ;)

    I guess we have different definitions of "delivered". As to me dumping goods in a garden is far from being 'delivered'.

    Dumping the goods in the garden is a lot better that any old garden though. Don't you agree? :D
