AXA insurance refusing to pay claim

Thanks again inside insurance - I think that's a good point.
Hi Stator - the investigation is not yet complete. Initial toxicology shows alcohol but not determined if contributed to, although assumption may be that decision making was impaired because of consumption.

Thanks for the comments and feedback appreciated. Re initial toxicology was 2.8, which we've read can mean impaired decision making, which is a reason AXA have said the claim isn't valid.
However as the full circumstances haven't yet been determined, we are struggling to understand why the claim has been refused.

I think this is the exclusion they are using
Any claim resulting from you attempting or committing suicide; deliberately injuring yourself; using any drug not prescribed by a registered medical practitioner, being addicted to any drugs, or abusing solvents, drugs, or alcohol, or being under the influence of drugs, solvents, or alcohol.
TBH If the full circumstances have not yet been determined but there is a possibility that Alcohol played a part it's not really surprising that AXA have declined to pay. I think that FOS may very well sit on the fence until the full circumstances have been determined (AXA may change their stance if the full circumstances indicate that although "under the influence" this was not a major factor).0
