Retailer refusing to refund money

    I tried to get the correct information about refunds on this consumer rights forum and unfortunately the replies I received are completely unhelpful because no one who posted seems to know the correct consumer rights information. I'm sure members posted with good intentions but that is not the point.

    Instead of posting misinformation please in future do not post anything at all unless you're sure you know what you're talking about. People who post here are trying to find the correct information and it is utterly demoralising to wade through misinformation and OT discussions in a consumer rights forum.

    This morning I informed MyMemory again, at their insistence and because none of the information here offered any help challenging their decision, that I had not received my order allegedly sent out a month ago. Let's see if they come up with another excuse to delay a refund which probably no one here will have a clue about whether or not is legal.

    I wonder how many other ripped off customers have posted threads here hoping for the correct advice and been disappointed? What's the point of a consumer rights forum if no one here knows them? I'm really angry about this because I thought the one place I could go to get the correct information about consumer rights was MSE but apparently not. Being ripped off is no joke nor a trivial matter. It left me feeling taken advantage of, angry and helpless. It's despicable that companies can get away with these practices and this forum should offer the correct information so we can assert our rights.

    It's a memory card and you are feeling helpless?

    Next time you are in such a dire situation pay for some advice. You were told that they are governed by Jersey law and as such, timescales on refunds are unclear. I believe there will be Jersey law specialists who could have hepedyou, but for free? No :p

    If you think on here is bad, wait until you try and get a professional legal opinion and that will cost you money.

    The folk on here have offered their opinions free of charge and most offer good advice or snippets that might be helpful.

    I would suggest your next port of call is your solicitor (but he might be wrong too).

    I feel that you are being very unfair to your fellow forum members. There are many who post on here regularly with very effective advice regarding SOGA, CCRs, failed delivery, damaged goods, faulty goods, warranty issues etc, etc. The issue you have is that your purchase is not governed by UK legislation. Do you really expect that members of a UK based forum should have in-depth knowledge of Chinese, United States ....... or Channel Islands consumer laws?.

    Perhaps there is a Channel Islands equivalent of MSE whose members might be able to assist you.

    In my experience this forum is unhelpful and I'm entitled to that opinion. And no, I'm not grateful for misinformation - just annoyed by it. The person who wonders why I'm so upset over a memory card probably has no empathy and loads of money to throw around. That's just the kind of attitude you don't need on a consumer rights forum.

    In summary the feedback here is that if I buy something in the UK that is shipped from the Channel Islands it's not bound by UK law? Says who? There is no evidence to back up this assumption so it's just speculation. This is exactly the point I'm making. Rather than posting contradictory opinions why not post factual information that might actually help? What is the point of coming to a consumer rights forum if no one knows the correct information or misinforms you? Telling people to hire a solicitor because someone points this out is a defensive reaction made by those who don't want to hear any constructive criticism.

    After specifically requesting a refund on 9th July and waiting until 20th July as requested by MyMemory I contacted them again today requesting a refund. Instead of issuing a refund they claim to have sent out a replacement so no doubt this will be another ground hog day experience. I've put in a Paypal claim to get my money back. No wonder these companies can get away with practices like this when it's so difficult to get accurate information even on a consumer rights forum!

    MyMemory are based in Sweden, not Jersey and according to their own excuses for non-delivery to other customers on Trust Pilot they often send products from Switzerland. Apparently the waiting period for them to action non-delivery varies from customer to customer so this inconstancy is clearly opportunistic rather than based on carrier requirements. Based on Trust Pilot reviews, failed delivery isn't a rare incident with this company so if my thread has done nothing other than alerting someone to avoid MyMemory at all costs then I'll be satisfied.

    It is my opinion, and I am entitled to this opinion, that most of the information offered on this Consumer Rights board is offered with the best intentions of the poster. It is important to remember that posters are only offering opinions and this is explaned in the forum rules.

    No, that is not what was said or even implied.
    It is an important distinction, but the 'opinions' offered suggested that if you buy something [STRIKE]in[/STRIKE] from the UK that is shipped from the Channel Islands it's not bound by UK law.

    In a similar manner, If you were to purchase an item from a seller in China, that purchase would be subject to the laws of China.

    Anyway, that is only my opinion. Feel free to to ignore it if you wish.

    I will ignore your advice because it's completely wrong! MyMemory are based in Sweden which is in the EU and ships from Switzerland according to their PR rep on Trust Pilot. They even made the excuse to one customer that delivery was delayed because of the strike in Calais. Since when has anything sent from Jersey to the UK had to pass through France?

    You are welcome to hold an opinion but that is not what I requested! I asked what my consumer rights were in this case. So far that question has not been answered. If no one on a very popular consumer rights forum can help explain what the rights of consumers are when purchases are not delivered then what help is it? That is a very valid and appropriate criticism!
